Esse espaço físico que surge inerente à condição humana é o que hodiernamente denominamos como moradia. E por se tratar de algo tão intrinsecamente ligado ao indivíduo, não se tardou por reconhecer o acesso ao lar como sendo um verdadeiro direito humano. Assim, o que se assistiu no âmbito internacional foi o surgimento de diversos instrumentos de proteção e promoção deste direito. O presente estudo concentrará esta questão principalmente no Brasil, onde abordará o tratamento constitucional dispensado ao direito à moradia. Para alcançar tal desiderato, será necessário travar diálogos com a sociologia (no que tange ao aspecto sociológico da moradia), a arquitetura, o urbanismo e o Direito Urbanístico, pois não há como pensar na moradia dissociada de sua ambiência natural, ou seja, a cidade. Sendo certo de que não ficaremos adstritos aos conceitos ligados à moradia, bem como sua proteção jurídica, avançaremos em nossa pesquisa, com a análise das políticas públicas empreendidas pelo Estado brasileiro, especialmente no pós 88, ou seja, na nova ordem constitucional. Nosso objetivo será demonstrar que a maioria destas medidas políticas foram insuficientes para a resolução do deficit habitacional, especialmente na camada da população de baixa renda. À guisa de conclusão, demonstraremos as possíveis alternativas que o poder público pode empreender para reduzir esta gigantesca mazela social. / Since very early, man has always searched for his own space; either to obtain protection from nature’s rage or to shelter his match or offspring. This space is what we currently name dwelling. And because it is intrinsically connected with man, entitling him to a home, as a true human right, did come without delay. Thus, the coming of several instruments of protection and the promotion of this right was able to be observed internationally. This study will mostly focus on this question in Brazil, where the constitutional treatment toward the entitlement to housing will be approached. In order to do this, it will be necessary to talk to sociologists (on the subject of the sociological aspect of dwelling), architects, specialists on urban matters, and Urban Rights, for it is not possible to dissociate dwelling from its natural environment, i.e. the city. As it is certain that we will not be limited to housing only, as well as to its legal protection, we will go further into our research, analyzing the policies performed by the Brazilian Government, especially in the post-88, i.e. according to the new constitutional order.We aim to demonstrate that most of these political measures have not been satisfactory in order to solve housing deficit, especially in the low-income social layers. In conclusion, we will demonstrate that there are possible alternatives which public authorities can make use of in order to put an end to social blackspots
