Previous issue date: 2009 / Resumo: O entendimento da educação como direito do cidadão e dever do Estado remonta o final do século XIX e início do século XX, sendo fruto do jogo de forças sociais em conflito. Assim, a educação torna-se um problema público, que busca sua inserção nas agendas de governos na busca de soluções. A educação como direito se inscreve, portanto, no campo das políticas públicas de corte social. Esta pesquisa documental e bibliográfica inscreve-se na temática Ensino Fundamental de nove anos, tendo como área a Política e os sistemas Educacionais, e subárea Política e Legislação de ensino. Objetiva traçar o caminho legislativo da política educacional brasileira de ampliação da escolaridade obrigatória de oito para nove anos de duração com a inserção da criança de seis anos de idade, no período compreendido entre 2003 e 2008. Tomamos o imperativo legal nos âmbitos da federação brasileira e do Estado de Minas Gerais na busca de respostas para as seguintes questões: quais os sentidos implícitos e explícitos, apregoados pelos legisladores nos textos legais e nos documentos que organizam a ampliação do Ensino Fundamental, nos âmbitos da Federação e do Estado de Minas Gerais? Como isto se traduz na formulação de uma política pública? Na coleta de dados utilizamos a normatização federal e estadual mineira como fontes primárias e os autores Aguilar Villanueva (1996); Cunha (1986); Cury (2002); Kramer (2006); Nascimento (2001), Rein e Rabinovitz (1996); Romanelli (2000, 2007) e Saviani (2006), dentre outros. Os estudos realizados nos permitem afirmar que a ampliação da escolaridade obrigatória com a inserção da criança de seis anos de idade no Brasil e em Minas Gerais esteve e ainda continua envolto em polêmicas e conflitos que envolvem forças e correlação de forças, no entanto não há dúvidas quanto aos avanços no sentido de entender que de fato a educação é um direito de todos. / Abstract: The understanding of education as a right to the citizen and a duty of the State started in the late 19th century and beginning of the 20th century, as a result of conflict between social forces. This means education becomes a public affair, trying to have some space in the government's agenda to solve its problems. The education as a right is settled down in the area of public politics of social court. This documental and bibliographic research is part of nine years of elementary teaching thematic, having as a area the Policy and Education System and sub-area of Policy and Legislation Teaching. Its purpose is to draft the legislative path of the Brazilian education policy of enlargement of the obligatory scholarity which is eight years to nine years in duration, introducing children of six years old, between the years 2003 and 2008. It used the scope of legal imperative of Brazilian Federation and the State of Minas Gerais, seeking answers to the following questions: what are the implicit and explicit senses announced by the lesgislators in the legal texts and in the documents that organize the enlargement of the Elementary Teaching in the field of Brazilian Federation and the State of Minas Gerais? What is the meaning of it in the formulation of a public policy? To collect the data we used the Federal and the Minas Gerais State norms as primary sources and the following authors Aguilar Villanueva (1996); Cunha (1986); Cury (2002); Kramer (2006); Nascimento (2001), Rein e Rabinovitz (1996); Romanelli (2000, 2007) e Saviani (2006), among others. The studies allow us to affirm that the enlargement of the obligatory scholarity introducing children of six years old in Brazil and in Minas Gerais State was and still is surrounded by controversies and conflicts that include forces and co-relation of forces.
