Previous issue date: 2017-08-14 / The present work aims to make a study of the contemporary philosophy of law and the legacy of philosophers in relation to social, legal and political forms. In the first moment, a didactic demonstration of the philosophy of contemporary law and the social form will be made. From the conception of the social form the origin of the juridical form will be brought bringing in its bulge the relations between subjects of right. Later, a logical and evolutionary approach will be taken to the emergence of the political form, trying to answer the question of the interconnection between political form, legal form and citizenship as a consequence of the capitalist form of state, within the independence of such institutes. The present work integrates the line of research of Citizenship Modeling the State once it is discussed the approach of the citizenship context as one of participation of the subjects of law that integrate the legal form in the consequent conformation with the state political form. The method used will be bibliographic. / O presente trabalho tem como objetivo fazer um estudo da filosofia do direito contemporânea e do legado dos filósofos em relação as formas sociais, jurídicas e políticas. No primeiro momento, será feita uma demonstração didática da filosofia do direito contemporânea e a forma social. Dentre a concepção da forma social verificar-se-á a origem da forma jurídica trazendo em seu bojo as relações entre sujeitos de direito. Posteriormente, será realizada uma abordagem lógica e evolutiva do surgimento da forma política, tentando responder a questão da interligação entre forma política, forma jurídica e a cidadania como consequência da forma capitalista de estado, dentro da independência de tais institutos. O presente trabalho integra a linha de pesquisa da Cidadania Modelando o Estado uma vez que discute-se a abordagem do contexto da cidadania como uma de participação dos sujeitos de direito que integram a forma jurídica na consequente conformação com a forma política estatal. O método utilizado será bibliográfico.
