impacts and effective deployments arising from its actions in the formulation of
policies Especially in the field of education. Its objective is to analyze how democratic
management of public education is expressed in legal texts that give support to the
municipal education systems of the state of Maranhão. The research has contribution
in the historical-dialectic approach (TONET, 2016) uses the laws of the Municipal
Education Systems, Municipal Councils of Education and Organic Laws of the
Municipalities of Barreirinhas, Codó and Icatu as privileged sources of data for a
documentary analysis. The procedures of inclusive research, still, ample literature
review in the area. Firstly, Brazilian federalism is approached to understand the
principles of decentralization and autonomy, based on Abrucio (2005), Abrucio
(2010), Abrucio; Franzese (2007), Costa; Wedge; Araújo (2010), Souza (2005),
Arretche (2002) and Fernandes (2012), as well as their conceptions and
characteristics for the municipality and education. (2009), Gadotti (1994), Cury
(2000), Saviani (1994), the Commission for Studies and Research (2009), Lagares
(2009) and Santos (2014), especially for an institutionalization of municipal State of
Maranhão. Identification of 217 existing municipalities, only 18 have a law creating
Municipal Education System. Finally, an analysis of the principles of democratic
management, articles in articles 206 and 3, of the Federal Constitution of 1988 and
LDB / 1996, respectively, is analyzed in the legislation of the Municipalities of
Barreirinhas, Codó and Icatu. We conclude that the cooperative federalism proposed
in the legislation is far from being achieved, because the federated entities had
different competencies to implement public policies, results of financial and technical
inequalities, mainly because there are no clear mechanisms within the analyzed laws
that stimulate cooperation for Overcoming existing political, institutional,
organizational and cultural funding. There is still a long way to go, there is no sense
in making and extending the principle of democratic management and its conceptions
within the scope of the laws analyzed, however, we generally note that there are
significant efforts and advances in the search for greater autonomy And

Maranhão. / Este trabalho tem como eixo central a análise do Estado, as transformações, os
impactos e os desdobramentos efetivos decorrentes de suas ações na formulação de
políticas públicas, sobretudo no campo da educação. Tem como objetivo analisar
como se expressa a gestão democrática do ensino público nos textos legais que dão
sustentação aos Sistemas Municipais de Educação do estado do Maranhão. A
pesquisa tem aporte na abordagem histórico-dialética (TONET, 2016) e utiliza as leis
dos Sistemas Municipais de Educação, Conselhos Municipais de Educação e Leis
Orgânicas dos municípios de Barreirinhas, Codó e Icatu como fontes privilegiadas de
dados para a análise documental. Os procedimentos de investigação incluíram, ainda,
ampla revisão de literatura na área. Em um primeiro momento, abordamos o
federalismo brasileiro para entender os princípios da descentralização e autonomia,
com base em Abrucio (2005), Abrucio (2010), Abrucio; Franzese (2007), Costa;
Cunha; Araújo (2010), Souza (2005), Arretche (2002) e Fernandes (2012), bem como
suas concepções e características para o município e a educação. Em um segundo
momento, buscamos analisar a efetivação da criação dos SME a partir do princípio da
gestão democrática refletindo as concepções e características desse processo a partir
dos estudos de Bordignon (2009), Gadotti (1994), Cury (2000), Saviani (2009),
Lagares (2009) e Santos (2014), sobretudo, para a institucionalização dos sistemas
municipais de educação do estado do Maranhão. Identificamos que dos 217
municípios existentes, somente 18 possuem lei de criação de Sistema Municipal de
Educação. Por fim, analisamos a efetivação do princípio da gestão democrática,
colocado nos artigos 206 e 3º, da Constituição Federal de 1988 e LDB/1996,
respectivamente, na legislação dos Municípios de Barreirinhas, Codó e Icatu.
Concluímos que o federalismo cooperativo proposto na legislação está longe de ser
alcançado, em virtude de os entes federados possuírem capacidades diferentes para
implementarem políticas públicas, decorrentes das enormes desigualdades
financeiras e técnicas e, sobretudo, por inexistir mecanismos claros no âmbito das leis
analisadas que estimulem a cooperação para superar os aspectos financeiros,
político-institucionais, organizacionais e culturais existentes. Há ainda um longo
caminho a percorrer, no sentido de efetivar e ampliar o princípio da gestão
democrática e suas concepções no âmbito das leis analisadas, contudo, registramos
de um modo geral, que existem esforços e avanços significativos pela busca de uma
maior autonomia e efetivação desse princípio no âmbito dos sistemas de educação no
Estado do Maranhão.
