Este trabalho analisa a retextualização como estratégia de discursividade, por concluintes de Direito, em suas monografias. Partimos da análise das estratégias de retextualizações, em cujos processos se envolve a compreensão. Procuramos observar como o discente se constitui em sujeito de seu discurso, analisando, também, as interferências de sua interpretação, no trato com o texto matriz. Apontamos alguns procedimentos cognitivos no momento da construção do discurso jurídico, analisando as modificações sintáticas, lexicais e semânticas. Trata-se de uma reflexão necessária sobre a importância da retextualização na construção do discurso jurídico acadêmico, que possibilitou construir uma categorização nas estratégias lingüísticas desenvolvidas nos textos pesquisados, propondo-se um novo enfoque no ensino da linguagem jurídica, através de atividades de retextualização que, realmente, insiram o aluno do curso de Direito, de forma reflexiva e crítica, nessa comunidade lingüística / This work analyses how the retextualization was used in juridical discourses by Law students in their Monographs. The concept of retextualization, including comprehension, was adaptated to observe the use of paraphrase in this context. We observed how the students see themselves as an author of their discourses, even when they do a simple copy of the ideas derived from other discourses. In addition, it was observed that the retextualization done by the students in their juridical discourses follow some linguistical strategies. The results pointed to a necessary reflection of the ways in which the juridical language has being taught in Law courses. Activities that make the students think more critically about their juridical discourse are necessary
