Inserido dentro da perspectiva crítica, sem ostentar qualquer preocupação com o
dogmatismo normativista, a pesquisa apresenta uma aproximação entre o marxismo, os
conflitos sociais contemporâneos e o reflexo sobre o reconhecimento jurídico. Com
arrimo no método dialético-materialista, a abordagem pretende enfrentar os seguintes
problemas: Qual o grau de interferência do espaço urbano no processo de produção,
reconhecimento e efetividade de direitos? Em que medida é possível afirmar que o
exercício da cidadania ativa serve como força política propulsora atuante na
conformação normativa? Até que ponto é plausível sustentar que a cidade é o principal
palco dos conflitos sociais, no qual há o surgimento de demandas juridicamente
reconhecíveis? Dentro do universo de perspectivas que o tema poderia atrair, partiu-se
do elemento que apresenta maior imediatismo ao espaço urbano: a pessoa, vinculando-a
ao revés da pretensa dissolução do referencial analítico ―classe social‖. Esquivando-se
de incursionar em uma tradicional parte história, no mais das vezes posta de maneira
desconexa ao objeto de estudo, optou-se pela elaboração de uma análise de conjuntura
baseada na investigação dos fenômenos cotidianos. Buscando captar a dinâmica
reivindicatória contemporânea, discute-se os contornos da política contestatória que se
desenvolve no espaço urbano, dando ênfase à questão das subjetividades coletivas (o
abandono da mitificação do proletário), bem como do papel exercido pelas minorias
ativas, tendo como premissa a individualização. Como reflexo, levanta-se a hipótese de
se repensar o conceito de emancipação humana, procedendo a uma abertura léxicosemântica,
para aglutinar a pulverização de demandas sociais que despontam no
cotidiano do capitalismo urbano, fazendo com que se ilumine a possibilidade fática da
existência de emancipações parciais. Em síntese, pretende-se efetuar um estudo
preocupado com as práticas sociais emancipatórias que, de alguma forma, consiga
contribuir para a compreensão do mecanismo de produção normativa que tem como

dogmatism, this research shows a connection between Marxism, contemporary social
conflicts and the reflection on the legal recognition. With support in the dialectical
materialist method, the approach aims to face the following issues: In what degree urban
space interferences on the production, recognition and effectiveness of rights processes?
To what extent it can be said that the exercise of active citizenship serves as a political
force capable of driving the conformation of rules? To what extent is plausible to
maintain that the city is the main stage of social conflicts in which there is an emergence
of demands legally recognizable? Within the universe of perspectives that the topic
could attract, this work started with the element that has greater immediacy to urban
space: the person; linking her to the alleged failure of the dissolution of "social class" as
an analytical framework. Dodging an incursion on a traditional history part, most often
placed in a disconnected way to the object of study, it was decided to prepare an
analysis of context-based investigation of everyday phenomena. Seeking to capture the
contemporary vindicatory dynamic, this study discusses the contours of antiestablishment
politics that unfolds in the urban space, emphasizing the issue of
collective subjectivities (the abandonment of the proletarian mythologizing), as well as
the role played by active minorities, taking as its individualization premise. As a
consequence, raises the hypothesis to rethink the concept of human emancipation by
making a lexical-semantic gap to unite the spraying of social demands that emerge in
daily urban capitalism, making it blunts the factual possibility of the existence partial
emancipation. In summary, intends to carry out a study concerned with emancipatory
social practices that, somehow, can contribute to the understanding of the normative
production mechanism that has as its source the exercise of active insurgent citizenship
with some charge of disobedience.
