Instituto Nacional de Controle de Qualidade em Saúde / A pesquisa apresenta um perfil das ações de vigilância sanitária sob os princípios constitucionais da administração pública e sua correlação com os direitos dos pacientes. Discute o Programa de Acreditação implantado pela Agência Nacional de Vigilância Sanitária (ANVISA) em convênio com a Organização Nacional de Acreditação (ONA) e seus resultados para o setor hospitalar após sete anos de implantação. Correlaciona os atos legais e a Acreditação hospitalar. Coteja as conclusões do Relatório do Banco Mundial (2008), dados estatísticos oficiais e denúncias, como possíveis situações de transgressões na prestação de serviços hospitalares no Estado do Rio de Janeiro. Identifica a ausência de um roteiro de inspeção para hospitais fundamentado nas leis e regulamentos para gerar evidências objetivas destas situações. Revisa os roteiros de inspeção oficiais existentes e conclui que as iniciativas de padronizar as inspeções sanitárias de hospitais não lograram êxito, ao contrário do que ocorreu na área de fiscalização de medicamentos e produtos para a saúde. Busca, identifica, interpreta e agrupa os atos legais e regulamentos profissionais conforme o assunto tratado. Constrói um roteiro de inspeção com 14 módulos, tendo como marco teórico o roteiro de inspeção para empresas fabricantes de medicamentos. Correlaciona cada item de verificação com as 118 referências utilizadas. Desenvolve um estudo de correlação entre a hierarquia dos atos legais e o critério de avaliação dos itens de verificação. Classifica os itens e destaca os de maior grau hierárquico. Finalmente, sugere a utilização desta ferramenta para comprovar o cumprimento regulatório, ou ao contrário estimar seu desvio, propiciando uma oportunidade de adequação e melhoria. Conclui ser este o primeiro passo rumo ao reconhecimento externo da qualidade assistencial. / The research presents a profile of the actions taken through sanitary surveillance under the constitutional principles of public administration and its association with the patient’s rights. It discusses the Accreditation Program entrenched by the National Agency of Sanitary Surveillance (Agência Nacional de Vigilância Sanitária – ANVISA) in agreement with the National Accreditation Organization (Organização Nacional de Acreditação - ONA) and its results for the hospital sector after five years in operation. Correlates the legal acts and the hospital Accreditation. Assembles the Global Bank Report’s (Relatório do Banco Mundial, 2008) conclusions, official statistic data and criticisms, as possible transgression situations in hospital services in the county of Rio de Janeiro. Identifies the absence of an inspection itinerary in the hospitals specified in the law and regulations to generate objective evidence of these situations. Revises the existing official inspection itineraries and concludes that the initiative to regulate the hospitals’ sanitary surveillance weren’t successful, unlike what happened to the medicine and health products inspection areas. Researches, identifies, interprets and selects the professional legal acts and regulations corresponding to the specific topics. Builds an inspection itinerary with 14 modules, having as a theoretic guide the inspection itinerary from the medicine manufacturing companies. Correlates each verified item with the 118 used references. Develops a study of correlation between the hierarchy of the legal acts and the evaluation criteria of the verifying items. Classifies the items and highlights the ones at the top of the hierarchy. Finally, suggests the use of this tool to prove the regulatory compliance, or in the other hand to estimate its misapplication, providing an opportunity for adaptation and improvement. It concludes that this is the first step to the external recognition of caring quality.
