Este estudo trata da impossibilidade de a OMC se constituir em uma corte internacional para a análise de casos atinentes à violação ao Direito da Concorrência. Na primeira parte, apresentaremos aspectos ligados à organização que éobjeto deste estudo, em especial, aspectos histórico-gerais, com destaque para os temas ligados ao Direito da Concorrência, e os princípios gerais da organização. Na segunda parte, analisaremos de forma mais detalhada o diálogo entre o Direito Internacional da Concorrência e o Direito do Comércio Internacional, seja de afinidade, seja de divergência, concluindo com a apresentação dos fatores que vedam a OMC de tornar-se, no contexto em que ela se apresenta atualmente, uma corte internacional para casos envolvendo o Direito da Concorrência em âmbito internacional. / Study about the impossibility of the WTO to become a international court to the analyse of cases about International Competition Law violations. In the first part, we will present aspects linked to the organization object of this study, specially historical-general aspects, with highlights to the subjects linked to the Competition Law and the general principles of the organization. In the second part, we will analyse in a most detailed way the dialogue between the International Competition Law and the International Trade Law, either for afinity, or for divengence, concluding with the pesentation of the factors that become impracticable the WTO become, in the its context nowadays, a international court of casos involving the International Competition Law in a multilateral sphere.
