Previous issue date: 2016 / The research investigates how is the performance of the judiciary of Ceará in urban land conflict resolution in private real estate, from the analysis of first-degree judges decisions in collective possessory actions filed in civil courts in the city of Fortaleza in the period of 2010 to 2014. The analysis of the decisions uses the neoconstitutionalistic paradigm, taking into account the issue of judicialization of politics, and considers that the judicial interpretation is not a formal or a scientific revelation of the truth, but is part of a discourse in which there are ideological actors that are in power relations. The research discusses the absences in the judicial treatment of the conflict, especially of the defendants, which are the occupiers, and institutional actors that have related responsibilities. From the analysis of the decisions, this work discusses how they are marked by the subjectivity of the judge; the dominance of the concept of ownership as a simple mean of property protection, to the detriment of other concepts forged in civil and urban legislation and the silence about the social function of urban property. The study questions about the special treatment given to the property in legal system from the construction of the idea of real rights and its impact on the possessory protection. The work addresses the judicial eviction in land conflicts based on international human rights law and civil law and civil procedure rules, noting its punitive and personal nature incompatible with the system of judicial enforcement and civil liability. / A pesquisa investiga como se dá a atuação do Poder Judiciário cearense na resolução de conflitos fundiários urbanos em imóveis privados, a partir da análise de decisões de juízes de primeiro grau em ações possessórias coletivas ajuizadas em varas cíveis, na cidade de Fortaleza no período de 2010 a 2014. A análise das decisões parte do paradigma neoconstitucionalista, levando em conta a problemática da judicialização da política, e considera que a interpretação judicial não é uma revelação formal e científica da verdade, mas parte de um discurso em que existem atores ideológicos em relações de poder. A pesquisa discute as ausências notratamento judicial do conflito, em especial dos réus das ações, que são os ocupantes, e de atores institucionais que tem atribuições relacionadas. A partir da análise das decisões, o trabalho aborda como elas são marcadas pela subjetividade do juiz; o predomínio da concepção da posse como simples meio de proteção da propriedade, em detrimento de outras concepções forjadas na legislação civil e urbanística e o silêncio sobre a função social da propriedade urbana. O estudo faz o questionamento sobre o tratamento privilegiado conferido à propriedade no ordenamento jurídico a partir da construção da ideia de direitos reais e os seus reflexos na tutela possessória. Aborda o despejo judicial em conflitos fundiários à luz do direito internacional dos direitos humanos e do direito civil e processual civil, observando o seu caráter punitivo e pessoal, incompatível com a sistemática de execução judicial e responsabilidade civil.
