Previous issue date: 2017 / It is a research on individual constitutional duties, as an autonomous legal category, based on
the Federal Constitution of 1988. Initially, it analyzes the contemporary context of the socalled
"Age of Rights" as a phenomenon of creation and proliferation of new rights, and the
possible negative effects that this trend can bring, in different aspects, for man and society. It
presents a brief historical view of the duties, observing the main differences between the
classic view and the modern view on the subject, besides making a brief study of the duties
from the works of some of the most important authors of these two periods. Then, brief
considerations are drawn about the theory of individual constitutional duties, such as concept,
grounding, typology, and applicability. Finally, it analyzes the individual constitutional duties
present in the Federal Constitution of 1988 and proposes the possibility of including a list of
individual duties in the constitutional text. / Pesquisa sobre os deveres constitucionais individuais, enquanto categoria jurídica autônoma,
à luz da Constituição Federal de 1988. Analisa, inicialmente, o contexto contemporâneo da
chamada “Era dos Direitos”, como um fenômeno de criação e proliferação de novos direitos,
e os possíveis efeitos negativos que essa tendência pode trazer, em diferentes aspectos, para o
homem e a sociedade. Apresenta uma breve visão histórica dos deveres, observando as
principais diferenças entre a visão clássica e a visão moderna sobre o tema, além de fazer um
breve estudo dos deveres a partir das obras de alguns dos mais importantes autores desses dois
períodos. Em seguida, traça breves considerações a respeito da teoria dos deveres
constitucionais individuais, como o conceito, a fundamentação, a tipologia e a aplicabilidade.
Por fim, analisa os deveres constitucionais individuais presentes na Constituição Federal de
1988 e ventila a possibilidade de inclusão de um rol de deveres individuais no texto
constitucional.
