Previous issue date: 2009 / Apparently, the 1988 constitutional order settled the Rule of Law in Brazil, moving away the State governed by Martial Law, which characterized the 1964 Military Regimen. However, when we look at the past and at the present, we find out that exceptional spaces and techniques remain in the current society, which are revealed as if they were democratic instruments, allowing us to state that, after the 1988 constitution, the Martial Law had adapted to a new logic of forces, entering into the system “gaps” and becoming imperceptible to the normality. In order to understand the current Martial Law in Brazil, it is crucial analyzing the formation of the Brazilian State-Nation and further moments of the country history, provided that the 1964 Military Government was not the only one to introduce it. This complex approach is critical, since the confrontation of several views allows identifying the Martial Law manifestations. Here, the social control techniques used by the police-politics during the 1964 Military Rule appear now as Exceptional Laws. These legal provisions, which may be identified according to a certain criterion, serve to intolerant criminological speeches, apparently humanitarian, but that aim at selecting internal enemies. Ahead of this, the political theories that understand the Martial Law as the suspension of the legal system based on a sovereign decision are not enough to explain this phenomenon in the contemporary Brazil. On the other hand, the most appropriate theories to explain the Brazilian reality are those that defend that the State ruled by a Martial Law became a rule, what allows a complex analysis indicating the system “gaps” through which the Exception flows indistinctly to normality. / A ordem constitucional de 1988, aparentemente, sedimentou o Estado Democrático de Direito no Brasil, afastando o Estado de Exceção que caracterizou o Regime Militar de 1964. No entanto, olhando o passado e o presente, verifica-se que persistem na atual sociedade espaços e técnicas de Exceção, os quais se manifestam como se fossem instrumentos democráticos, permitindo que se afirme que, após a constituição de 1988, a Exceção adaptou-se a uma nova lógica de forças, introduzindo-se nas “fendas” do sistema e tornando-se indiscernível à normalidade. Para que se entenda o atual Estado de Exceção no Brasil é fundamental analisar a formação do Estado-Nação brasileiro e os momentos seguintes da história do país, já que o Regime Militar de 1964 não foi o único a introduzir a Exceção. Essa abordagem complexa é fundamental, pois o cotejo de diversas perspectivas é que permite identificar as manifestações da Exceção. Nesse aspecto, as técnicas de controle social utilizadas durante a Exceção Militar de 1964 pela polícia política surgem na atualidade através de Leis de Exceção. Esses dispositivos legais, que podem ser identificados segundo determinado critério, atendem a discursos criminológicos intolerantes, aparentemente humanitários, mas que visam selecionar inimigos internos. Diante disso, as teorias políticas que compreendem o Estado de Exceção como a suspensão da ordem jurídica baseada em uma decisão soberana são insuficientes para explicar esse fenômeno no Brasil contemporâneo. Por outro lado, as teorias mais adequadas para explicar a realidade brasileira são aquelas que defendem que o Estado de Exceção tornou-se regra, o que permite a uma análise complexa indicar as “fendas” do sistema pelas quais a Exceção flui indistintamente à normalidade.
