Previous issue date: 2008 / The present study concentrates on an analysis of the dispositions of the Code of the Civil Process related to the anticipation of injunction and to precautionary injunction, towards a resystematization de lege ferenda, trying to propitiate a larger instrumentality to the process, turning it more effective. Nowadays, our code of process covers the anticipated measures and injunctions in dispersed points. In this work it is suggested to concentrate all aspects in book III, originally destined specifically to precautionary injunctions. It is still intended to demonstrate the need of proximity to processes for anticipated and precautionary injunctions. Legislative reforms are proposed to offer significant changes to the institutes. Still, some points related to anticipation of injunction and to the appealing system are seen. / O presente estudo concentra-se numa análise das disposições do CPC no que tange à antecipação de tutela e à tutela cautelar, com vistas a uma ressistematização de lege ferenda, buscando, assim, propiciar maior instrumentalidade ao processo, tornado-o mais efetivo. Atualmente, nosso código de processo trata das medidas antecipadas e cautelares em dispositivos dispersos. Neste trabalho, sugere-se a concentração de todos os dispositivos no livro III, originalmente destinado apenas às tutelas cautelares. Pretende-se ainda demonstrar a necessidade de uma maior aproximação procedimental das tutelas cautelares e antecipadas. São abordadas propostas de reformas legislativas que buscam oferecer significativas mudanças aos institutos. Ainda, são apresentadas questões relativas à antecipação de tutela e ao sistema recursal.
