Previous issue date: 2008 / The delicts practised for minors in the beggining of the twenty century excite interest in the measure where such great practices today generate preocupations in such a way on the part of the State how much for the society in general. Although the crimes practised currently become related it problems in the identified ones in the twenty century, as the case of the drugs, it searched to understand as this social problem was seen by the State. This work analyzed the decises of the crime process of the Cartório do Júri, of Porto Alegre, originated between the years of 1927 and 1933, located in the Public Archive of the State of the Rio Grande do Sul (APERS), in order to analyse the content and to identify as she was perceived, for the magistrates, the practices of delicts for minors. Process of transformation of relaes between the State and the individual from Modernity was verified, and as these had finished intervening also on organization of the family and practices them on the childhood. The occured transformations had been analyzed in aim at them concerning the childhood, mainly those appeared in Modernity, as well as the process that unchained the recognition of the childhood as a stage of the human development; and, finally, the practices adopted for the State for the control of the family and the child presented a vision of the crimes committed for minors in the capital of the State of the Rio Grande do Sul, what made by means of verify quantitative and qualitative of the crime process of the referring Cartório do Júri. Finally, if it more analyzed the data contained in the referring processes to the committed delicts - you injure corporal, robery and robbery and defloration -, on the basis of the decises pronounced for the magistrates, as well as the treatment excused for the judges to these delicts. / Os delitos praticados por menores no início do século XX suscitam interesse na medida em que tais práticas hoje geram grandes preocupações tanto por parte do Estado quanto pela sociedade em geral. Embora os crimes praticados atualmente relacionem-se a problemas não identificados no início do século XX, como é o caso das drogas, buscou-se compreender como esse problema social foi visto pelo Estado. Este trabalho analisou as sentenças dos processos-crime do Cartório de Júri, de Porto Alegre, originados entre os anos de 1927 a 1933, localizados no Arquivo Público do Estado do Rio Grande do Sul (APERS), a fim de verificar o conteúdo e identificar como era percebida, pelos magistrados, a prática de delitos por menores. Verificou-se o processo de transformação das relações entre o Estado e o indivíduo a partir da Modernidade, e como estas acabaram interferindo também sobre a organização da família e das práticas sobre a infância. Analisaram-se as mudanças ocorridas nas visões acerca da infância, principalmente aquelas surgidas na Modernidade, bem como o processo que desencadeou o reconhecimento da infância como uma etapa do desenvolvimento humano; e, por fim, as práticas adotadas pelo Estado para o controle das famílias e das crianças. É apresentado um panorama dos crimes cometidos por menores na capital do Estado do Rio Grande do Sul, o que é feito por meio da análise quantitativa e qualitativa dos processos-crime do Cartório do Júri referentes à temática.Por fim, se analisou os dados contidos nos processos referentes aos delitos mais cometidos – lesões corporais, furto e roubo e defloramento –, com base nas sentenças proferidas pelos magistrados, bem como o tratamento dispensado pelos juízes a esses delitos. Essa dissertação integra a área de concentração “Sociedade Ciência e Arte”, cuja linha de pesquisa chama-se “As fronteiras entre Tradição e Modernidade na construção do Estado Brasileiro”.
