Previous issue date: 2008 / The current paper has as main objective to critically analyze the PNAS and NOB-SUAS to get to understand the central determinants which guide the materializing process from the right to social protection of social assistance. Therefore, this paper defined as theorymethodological route the qualitative research, in the dialectic-historical reference, using bibliographical research to give theory support to documental analysis of National Policy of Social Assistance (PNAS) and Basic Operational Rule of Unique System of Social Assistance (NOB-SUAS). In this way, reflection is accomplished about the structuring marks for the Social Assistance Policy, taking into consideration a brief evaluation of the first 10 years of LOAS introduction. The analysis of the settings from the National Policy of Social Assistance, searches to give evidence to the principles, directions and objectives that guide it, including approach about the re-order of the social-assistant net. The current paper also integrates an analysis about functions attributed to the policy of Social Assistance, added to the approach about a new architecture political-institutional turned to the operation of the social-assistant protection model from SUAS. As a result of the research accomplished, it is seeing that for the effective materialization to the right to social protection it is needed, besides preview and formal rules, a deep study of the process of democratization from the society and the Brazilian State. So far, it is essential to guarantee to the set of citizens users, the effective exercise of policy right to act as main characters in the legitimating process, institutional order and social control in the introduction of rights secured by SUAS. / O presente estudo tem por objetivo primordial analisar criticamente a PNAS e a NOB-SUAS afim de compreender os determinantes centrais que orientam o processo de materialização do direito à proteção social de assistência social. Para tanto, o estudo definiu como arcabouço teórico-metodológico a pesquisa qualitativa, fundamentada no referencial dialético-histórico, utilizando-se da pesquisa bibliográfica para dar sustentação teórica à análise documental da Política Nacional de Assistência Social (PNAS) e da Norma Operacional Básica do Sistema Único de Assistência Social (NOB-SUAS). Desse modo, realiza-se uma reflexão sobre os marcos estruturantes para a Política de Assistência Social, agregando-se uma breve avaliação dos primeiros 10 anos de implantação da LOAS. A análise das configurações da Política Nacional de Assistência Social, busca evidenciar os princípios, diretrizes e objetivos que a orientam, incluindo abordagem sobre o reordenamento da rede sociaoassistencial. Integra também o presente estudo, análise sobre as funções atribuídas à política de Assistência Social, acrescida da abordagem sobre a nova arquitetura político-institucional voltada a operacionalização do modelo de proteção socioassistencial do SUAS. Como resultado da pesquisa realizada, constata-se que para a efetiva materialização do direito à proteção social, necessita-se, para além da previsão e regulamentação formal, o aprofundamento do processo de democratização do conjunto da sociedade e do Estado brasileiro. Desse modo, torna-se essencial, garantir ao conjunto dos cidadãos usuários, o efetivo exercício do direito político em atuarem como sujeitos protagonistas no processo de legitimação, ordenamento institucional e controle social da implementação dos direitos assegurados pelo SUAS.
