La protección de la salud y seguridad de los consumidores como derecho recogido en la Constitución Política del Perú y en el Código de Protección y Defensa del Consumidor busca concretarse, entre otros mecanismos, mediante el sistema de alerta y actuación oportuna frente a productos riesgosos. Dicho sistema establece la obligación del Estado de contar con un mecanismo preventivo que permita evitar que productos riesgosos se encuentren al alcance de los consumidores. La implementación del referido sistema de alerta temprana, prevista desde el 2010, viene dilatándose de modo que, a la fecha, no contamos con el mismo.
La presente investigación, aborda la problemática de la pendiente implementación del sistema de alerta y la falta de actuación oportuna frente a productos riesgosos, determinando la necesidad de su pronta implementación y los obstáculos que presenta a la fecha, como la nula claridad respecto de las competencias asignadas y la variedad de normas existentes que agravan dicha situación, entre otros.
Adicionalmente, se analizan los sistemas que diversos países han desplegado, observándose que se trata de un tema de reciente desarrollo, y se establecen las pautas a tomar para una implementación efectiva en nuestro país, entre ellas: (i) el fortalecimiento de las funciones de la autoridad de consumo , (ii) el monitoreo internacional para vigilar la seguridad de los productos que ingresan al país y, (iii) el intercambio de información constante con los hospitales y clínicas a efectos de determinar los productos que están generando lesiones y proceder con su retiro del mercado. / Health protection and security of consumers as a right derived from the Peruvian Political Constitution and the Code for Protection and Defense of Consumers searchs to establish, among other mecanisms, an alert system and proper intervention against risky products. This system establishes the necesity for the State to provide consumers with a mecanism that will avoid risky products to be available in the market. The implementation of this preliminary alert system, was supposed to be launched in 2010, but as in today is still not working.
This research, talks about the problems origin by the lack of the alert system and of proper intervention against risky and potentially dangerous products, determing the urgent necesity of its implementation and the obstacles it faces now a days, such as vague definition regarding its dues and resposabilities and the variety of existing rules and regulations that make this even more complicated, among other reasons.
Adittionally, we analyze and investigate some methods that other countries have aplied worldwide, finding out that this matter is quite new and is still being developed. We have established three key points as to assure an effective implementation in our country: (i) strenghening the responsabilities and role of the Consumption Authority, (ii) monitoring incoming products from abroad to prevent security issues and lastly, (iii) constant and permanent exchange of information and data with hospitals, clinics and health instutions with the sole purpose of identifying and listing products that are generating health problems and banned them from the consumers market. / Trabajo de investigación
