En el contexto de una concertación de precios, la prueba indiciaria es determinante
en la configuración de las conductas anticompetitivas bajo la conglomeración de indicios
acreditados unidos a un razonamiento lógico que aseguren la hipótesis planteada. Ello
considerando de manera integral los medios probatorios disponibles, construidos de manera
conexa entre sí. Las comunicaciones y la evidencia económica fueron vitales para confirmar la
imputación de concertación de precios del caso concreto. Al otorgarle mayor rentabilidad a
los agentes económicos que ejecutaron los precios colusorios, se afectó el bienestar del
consumidor, causando además menor eficiencia social en el mercado, privando a los
consumidores de una diversidad de opciones con calidades y precios distintos. Las medidas
correctivas contienen como idea nuclear la reposición de los efectos causados por el actuar
ilícito, lo cual se cumple en el caso concreto mediante la implementación del programa de
cumplimiento, sin olvidar la flexibilidad de su aplicación. Se recalca la consideración del
beneficio extraordinario y la gravedad de la sanción con respecto de la concertación de precios
imputada. / Considering the spectrum of price fixing, circumstantial evidence is crucial in the
construction of anticompetitive behavior, underneath the conglomeration of reliable indications
that are united to a logical reasoning that confirms the proposed hypothesis. The previous idea
is heavily connected to a consolidated examination of the available evidence. The economic
evidence and the accessible emails were vital to confirm the price fixing of this case. In the
moment the companies involved in the case executed the collusive and coordinated price, the
well-being of the consumer was affected, and also the social efficiency of the market, depriving
consumers of the liberty of a wide range of options related to quality and different prices. The
corrective measures contain as a fundamental idea the reinstatement of the effects caused by
the illicit behaviour, which occurs in the current case when the compliance programme is
implemented, with a quota of flexibility. The extraordinary benefit and the seriousness of the
fine are both emphasized regarding the price fixing analize in this document.
