Orientador: Daniel Damásio Borges / Banca: Murilo Gaspardo / Banca: Alberto do Amaral Júnior / Resumo: A inclusão das pessoas com deficiência no mercado de trabalho se apresenta como um dos temas essenciais no universo do movimento de internacionalização das normas de direitos humanos, principalmente, porque trata de um direito com forte repercussão na garantida da dignidade humana e na construção de uma sociedade livre, justa e igualitária para todos. Diante da centralidade do trabalho nas sociedades contemporâneas, a inclusão de uma pessoa com deficiência no mercado profissional é capaz de efetivar sua liberdade, garantindo-lhe autonomia, bem-estar, desenvolvimento e a própria condição humana, assim como compreendeu Hannah Arendt. Este trabalho apresenta uma análise das normas e ações afirmativas brasileiras que visam a efetivar esse direito de inclusão das pessoas com deficiência no mercado de trabalho à luz do direito internacional. Em perspectiva inclusiva, são considerados as principais ações e mecanismos legislativos brasileiros que protegem esse direito, com destaque para a Lei 8.213/1991, também conhecida como Lei de Cotas. Reconhece-se que as normas e ações afirmativas brasileiras estão em consonância com os instrumentos internacionais de proteção dos direitos humanos, embora a inclusão das pessoas com deficiência no mundo do trabalho, ainda, se apresenta como um direito de baixa efetividade. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The labor market inclusion of people with disabilities is an essential theme regarding the universe of the internationalization of human rights law, mainly, because it is a right with a strong impact on the guarantee of human dignity and building a free, just and equitable society for all. Given the centrality of work in contemporary societies, the inclusion of disabled persons in the labor market promotes their freedom, guaranteeing autonomy, the well being, development and the human condition as it is, as Hannah Arendt mentioned. This paper presents an analysis of the Brazilian laws and affirmative actions aimed at actualizing this right to inclusion of people with disabilities in the labor market, which is aligned with the international law. In an inclusive perspective, they are considered the main actions and Brazilian legislative mechanisms that protect these rights, especially the Law number 8.213/1991, also known as The Quota Law. It is recognized that the Brazilian laws and affirmative actions are aligned with the international instruments of human rights protection, although the inclusion of people with disabilities in the labor market also appears as a right of low effectiveness. It is an analytical, monographic work, built from a documentary and bibliographic research presented in an essay form, and which has as main reference the problem of the effectiveness of the law concerning what Jürgen Habermas proposed on the integrating social function that the law must have.
