This study is an idea-critical analysis of the Swedish state´s proposed handling of trans citizens need of a correct gender marker in relation to the administrative barriers in the population registration regarding legal gender markers. In 1972 Sweden was the first country in the world to form a Gender Recognition Act. Though groundbreaking at the time, the law is now outdated. Several counties have since then adopted modern legislation in line with the international developments of the human rights standard. The study is an idea critical analysis of the proposed changes to the Swedish Gender Recognition Act, where the study identifies two fields of conflict between trans citizens need for correct gender marker and the technical limitations of the population registration. Within those the study identifies six chains of inherent ideas that form the ideological background to the conflict. Furthermore, the study shows that the Swedish state wants to grant its citizens the right to legal gender recognition by adopting self-declaration but the administrative barriers in the population registration, with the gendered individual number of identification (personnummer) at its core, makes it difficult. Based in a binary understanding of gender as a lifelong and predictable category, the state compromises its good intentions and, in the end, severely limits the principle of self-declaration by limiting the number of times one can change the legal gender marker by the method of self-declaration and by only providing two legal gender markers. Resulting in a misrecognition of non-binary citizens. The study also presents an alternative way of enhancing trans citizens right to correct legal gender marker. The aim of the study is to deepen the understanding of the state’s relationship to its trans citizens and hopefully contribute to the advancement of trans people’s human rights. / <p>2022-06-02</p>
