The purpose of the essay is to investigate how legal certainty is for abusive women and men. This is done by analyzing how the Administrative Court in Stockholm describes women and men in the appealing court decision regarding the preparation of care according to Care of Abusers Act (LVM). The empirical material consists of 20 judicial decisions from the Administrative Court. In order to reach a deeper understanding of the role of gender norms in the judiciary, the survey has been conducted with a gender perspective based on the purpose of the paper, we have considered questions about how women and men are described and whether there are any gender differences in the appealing court decision. To answer the questions, a text analysis based on a hermeneutic approach has been made, then linking the analyzed text in relation to previous research and the chosen theoretical concepts: social construction, stigma and gender. The general conclusions we have reached are that the gender differences described in the court coincide with the general gender norms in the society by describing the gender in various ways in the law application of LVM. This means that the Administrative Court does not fully consider everyone's resemblance to the law according to the principle of equality and objectivity in Instrument of Government (RF). The conclusions are explained by describing how gender is made in a construction process. / Uppsatsenssyfte är att undersöka hur rättssäkerhetenser ut förmissbrukande kvinnor och män. Det görs genom att analysera hur Förvaltningsrätten i Stockholm beskriver kvinnor och män i bifallande domstolsbeslut gällande beredandet av vård enligt Lag (1988:870) om vård av missbrukare i vissa fall (LVM). Uppsatsens empiri består av 20 stycken domstolsbeslut. För att få en fördjupad förståelse för könsnormers roll inom rättsväsendethar undersökningen gjorts urett genusperspektiv och utifrån uppsatsenssyfte har vi behandlat frågor om hur kvinnor respektive män beskrivs och om det finns könsskillnaderi bifallande domstolsbeslut. För att kunna svara på frågeställningarna har en textanalys utifrån en hermeneutisk metodansats gjorts, för att sedan knyta an den analyserade empirin i relation till tidigare forskning och de valda teoretiska begreppen: konstruktionism, stigma och genus. De slutsatser vi har kommit fram till handlar om att de könsskillnader som beskrivs i domstolsbesluten sammanfaller med de allmänna könsnormerna i samhället genom att könen beskrivs på olika sätt i rättstillämpningen av LVM. Det innebär att Förvaltningsrätten inte fullt ut beaktar allas likhet inför lagen enligt likhet-och objektivitetsprincipen i Regeringsformen (RF). Slutsatserna förklaras genom att vi redogör för görandet av kön i en konstruktionsprocess.
