Disputes over illegally cut down trees are common in Swedish courts and the question of how the damage should be assessed and compensated is the subject to many different solutions. Through NJA 2015 p. 199 (“Tallarna”) the Swedish Supreme Court established a method on how to evaluate damages in cases of illegally felled trees. The purpose of this thesis is to critically assess this method and to suggest a possible development that addresses some of the problems identified in the criticism.
