Ces dernières années sont marquées par un rapprochement entre le droit administratif et le droit privé. La jurisprudence administrative soumet désormais l'acte administratif au droit du marché. Des logiques privatistes intègrent le régime de la responsabilité et du contrat administratifs. Ce mouvement est habituellement appréhendé par la doctrine publiciste à travers l'analyse des activités régies par le droit administratif. La privatisation du droit administratif répondrait à une perte de spécificité du service public et une dilution de la notion d'intérêt général. Toutefois, le double constat de la pérennité du dualisme juridictionnel et de la distinction entre deux catégories de personnes juridiques, personnes publiques et personnes privées, incite à renouveler l'angle d'analyse. Nous proposons donc d'étudier les interactions entre les évolutions de la jurisprudence administrative et la notion de personnalité publique. / Recent years have witnessed a rapprochement between public law and private law. An administrative act is now in case law subjected to the market. Private law logics include the regime of liability and tender agreement. This trend is usually arrested by the privatist doctrine through the analysis of activities under public law. The privatization of public law would respond to a loss of specificity of public service and a dilution of the concept of public interest. However, two findings encouraged to change the way to analyse this: first the sustainability of a judicial dualism and then the distinction between two categories of legal persons, public entities and private individuals. We therefore propose to study interactions between the evolution of administrative case law and the concept of public legal person.
