L’expression « libertés collectives », employée jusqu’à présent pour désigner les libertés de la seconde génération, ne rend pas bien compte du contenu de ces libertés. Elles ne sont pas l’affirmation du droit collectif sur le droit individuel, mais des libertés individuelles qui ne deviennent effectives qu’en étant exercées collectivement. Pour figurer au mieux leur complexité, il convient de proposer une nouvelle appellation : libertés sociales. Il est nécessaire, pour justifier cette expression, d’étudier la genèse de ces libertés, à la faveur d’une analyse législative, jurisprudentielle, politique et doctrinale. L’observation de la corporation organique du Moyen Âge dévoile une différence de nature avec l’association libre. La singularité de cette dernière va apparaître tardivement, à la fin du XIXe siècle, à la faveur d’une définition moderne et d’un renouvellement du paradigme d’ordre. / The expression "collective liberties", used until now to designate the liberties of the Second Generation, does not fully represent the content of those liberties. Those liberties are not the affirmation of the collective right over the individual right, but of the individual liberties becoming effective when applied collectively. To best feature their complexity, a new term should be proposed: social liberties. It is necessary, to justify this new term, to study the genesis of those liberties, through a legislative, jurisprudential, political and doctrinal analysis. The observation of the organic corporation of the Middle Age reveals a difference of nature with the free association. Its singularity will only appear at the end of the XIX century, through a modern definition and a renewal of the order paradigm
