L'action disciplinaire dans la fonction publique territoriale en Thaïlande est intéressante car plusieurs problèmes apparaissent ainsi que de nombreux contentieux administratifs en matière de procédure. Les problèmes dans la procédure disciplinaire sont nombreux. A titre d’exemple, les multiples obstacles s'opposant à la reconnaissance de l'existence de la notion de faute disciplinaire ; la consistance des textes, le secret de la décision disciplinaire, l’absence de la compréhension de la procédure disciplinaire par l’autorité territoriale, faisant ainsi l’objet d’irrégularité et illégalité dans l’action disciplinaire, enfin, les droits et les libertés de l’agent local sont souvent violés. Cette étude s'intéresse d'abord à l'ensemble des théories, qui domine dans le contentieux disciplinaire de la fonction publique territoriale en Thaïlande. Il conviendra ensuite de s’intéresser à la question du régime disciplinaire, ce qui permettra d'analyser la différence fondamentale entre régime thaï et régime français. / Disciplinary action in civil service of local governments in Thailand is interesting because it has a bunch of problems to be resolved. In addition, there is administrative litigation, especially disciplinary procedure. For instance, the problems about disciplinary procedure are the obstacles in recognition of existence of the concept of disciplinary offence, the consistency (formation) of text, the secret of the disciplinary decision, the lack of understanding in disciplinary procedure of the territorial authority that causes the irregularity and illegality of disciplinary action, the right and freedom of local servant which are frequently violated. This study primarily focuses on all theories dominating the disciplinary litigation in the civil service of local governments in Thailand. Then, the study will answer the question regarding the issue of the disciplinary regimes, which will be able to analyze the fundamental difference between the Thai regimes and French regimes.
