RESUMÉ - Probleme des Institutes "Haft" Diese Arbeit befasst sich mit dem aktuellen und interessanten Thema - Probleme des Institutes "Haft". Dieses Instrument des Strafverfahrens verursacht viele Anwendungsprobleme, was zu einer reichlichen Rechtsprechung des nicht nur des Verfassungsgerichtes der Tschechischen Republik aber sondern auch des Europäischen Gerichtshofes für Menschenrechte führt. Die Haft stellt zweifellos ein äußerst sensibles Thema und einen der schwersten Verstöße gegen die grundlegenden Menschenrechte vor, die zur Sicherung der beschuldigten Personen für Zwecke des Strafverfahrens und der Strafvollstreckung dient, denn die persönliche Freiheit des Angeklagten wird damit begrenzt. Der eigene Text der Diplomarbeit ist in sechs Kapitel unterteilt. Die Einführung der Diplomarbeit widmet sich dem Exkurs in Geschichte dieses Institutes, und zeigt die Entwicklung der Haft in Verbindung mit den Änderungen von Strafprozessordnungen, vor allem nach dem Jahre 1989. Weiter wird die Aufmerksamkeit auf die verfassungsrechtliche und völkerrechtlichen Dokumente hingerichtet, die zum Schutz der persönlichen Freiheit und Limitation ihrer Beschränkung abgefasst worden sind. Divorcing Couples' Experience With Child Custody Mediation and Litigation

Couples who divorce are likely to experience increased levels of psychological distress, decreased levels of happiness, and increased levels of depression. To reduce these negative effects, litigators use mediation to resolve disagreements including child custody disputes. The purpose of this quantitative study was to compare divorcing parents' depression and satisfaction with the process after the use of mediation or litigation. Wexler's theory of therapeutic jurisprudence provided the theoretical framework. Data was collected from 170 participants who were recruited using convenience sampling through Facebook. Participants voluntarily completed a survey which included a researcher developed questionnaire, the Acrimony Scale, the Nonacceptance of Marital Termination, and the Center for Epidemiological Studies-Depression. Results from MANOVA and ANOVA analyses showed that participants who used mediation reported significantly higher levels of fairness and control than parents who used litigation. Findings could be used to inform divorcing parents that mediation may provide them with higher levels of fairness and control. Divorcing couples could be offered mediation services that are more effective and will more likely meet their needs. Court systems could offer mediation as a mandatory first step. This may reduce the number of cases that litigate. Since mediation is generally free, parents would not be forced to pay money for the services and they may end feeling that they had more control within their dispute. If more families experience more fairness and control within their dispute, their overall psychological wellbeing may be improved, thereby positively impacting social change.

Fem stycken globala banker inom området global custody valdes att studeras. Med utgångspunkt i tidigare teorier om företags arbete med innovation och genomlysbarhet studerades företagens information gällande innovation. De teorier som användes gällde företags genomlysbarhet samt tidigare forskning om hur banker arbetar med innovation. Källorna var företagens årsredovisningar för år 2007 samt företagens hemsidor. Arbetet utgick från de tre frågeställningarna om, förmedlar företagen innovation öppet och enkelt, går det att se möjliga framtida inkomster för företagen samt om företagen redovisar sina teorier med innovation? Utifrån resultaten kunde inga slutsatser dras på att företagen öppet och lättillgängligt redovisar sin innovation genom sina årsredovisningar eller hemsidor. Det som kunde utläsas från resultaten var på ett par skillnader på användandet av årsredovisningarna och hemsidorna. I årsredovisningarna bestod informationen av breda förklaringar om att innovation var viktigt för företagen och kunde innebära fördelar för företaget i framtiden. This paper explores parental alienation in custody and access litigation in Ontario, examining how parental alienation has been defined by various scholars, arguing in favour of the relevance of the term, and identifying a core definition which can be utilized in court. This paper also evaluates how Ontario courts have dealt with parental alienation claims to date, and identifies areas of weakness. Specifically, identification of, and response to, parental alienation is poor in cases where there are elements suggestive of both alienation and estrangement. Additionally, cases are not generally dealt with in a timely manner. Finally, this paper considers the possible benefits of youth acting as parties in parental alienation cases.

The mother and child reunion: a reconception of child custody litigation and mediation

Many women have shared with family lawyers such as myself their stories about how the legal system marginalized their maternal connections and child caregiving experiences by imposing on them legal positions and constructs about mothering and caring that differed from the reality of their experiences. This thesis develops the argument that neither the litigation nor the mediation of child custody disputes in Canada address the systemic problems association with the marginalization of women. Both processes reflect white, male, middle class, heterosexual expressions, productions and perpetuations of patriarchy. I first define the dominant ideology of motherhood and present differing mothering experiences which more accurately reflect the realities of caregiving. I then deconstruct the legal and social methods used in both the litigation and mediation of child custody in order to demonstrate their use of dominant ideologies of motherhood and family to limit women’s caregiving opportunities. From the context of two women’s legal experiences, I explore the possibility of introducing feminist legal methods into mediation and litigation in recognition of the fact that women must engage with the legal system to address the practicalities of childcare, economics and shelter. I respond to the popular argument that mediation is a panacea to the ills of litigation by taking the position that both are situated along a continuum perpetuating the same ideological assumptions about mothers and family which oppress all women to some degree. I argue that mediation is ultimately more oppressive to women because unlike litigation, systemic problems in mediation are obscured by romanticism and rhetoric. Firstly, I attempt a mother and child reunion by trying to create a place for feminist conceptions of caregiving within child custody litigation and mediation which would empower women. I conclude that it will be difficult to create a space for feminist methodology in custody litigation and mediation without the continued efforts of lawyers to reconstruct the ideology of mother.
