Les nouvelles formes de participation dans les forums publics de consommateurs : vers un dispositif de co-innovation / The new participative forms in public consumer forum : towards a plan of co-innovation

Dans ce travail de recherche, nous avons interrogé les pratiques des consommateurs d’un produit culturel et technologique - le livre numérique - dans les forums publics de discussion, avec pour objectif final d’identifier des usages de consommation innovants. Notre approche transdisciplinaire, s’est appuyée sur le cadre théorique de l’interactionnisme, en empruntant les concepts clés, de l’analyse des interactions quotidiennes (Erving Goffman) et de l’analyse des interactions verbales (Catherine Kerbrat-Orecchioni), en s’inscrivant dans les recherches sur le Document pour l’Action et des transactions coopératives dans une perspective d’innovation produit-marché (Manuel Zacklad). Dans une démarche d’observation non participante et éthique, nous avons procédé à l’analyse qualitative de plusieurs fils de conversation sur le livre numérique, issus du forum BOOKNODE.COM. Nos interprétations suggèrent que le forum de consommateurs est un espace collaboratif auto-géré/auto-régulé, dont l’activité dominante porte sur un échange de connaissances pratiques, reposant sur une expression argumentée d’un point de vue individuel ou un retour d’expérience commenté et détaillé. Nous soutenons que le forum de consommateurs restitue spontanément des usages de consommation difficilement décelables pour l’enquêteur. Toutefois, l’absence d’un modèle d’analyse satisfaisant pour déceler ces usages nous a donné l’occasion de construire une nouvelle grille de lecture, de suggérer une démarche interprétative. L’application de notre modèle - à améliorer - dans un dispositif de co-innovation, aboutit à la construction d’une offre de nouveaux contenus et de nouvelles situations d’usages possibles. / In this researching work, we questioned the consumer’s practices of a technological and cultural product - the digital book - in public forums of discussion, with the final objective of identifying innovative consumer habits. Our interdisciplinary approach is based on the theoretical framework of the interactionism, by borrowing the key concepts of the daily interactions analysis (Erving Goffman) and of the verbal interactions (Catherine Kerbrat-Orecchioni), by joining the researches on the Documents for Action (DofA) and the Cooperative Transactions in a prospect of innovation product-market (Manuel Zacklad). In an approach of non-participating and ethical observation, we proceeded to the qualitative analysis of several threads of conversations on the digital book, observed in the forum BOOKNODE.COM. Our interpretations suggest that the consumer forum in a self-managed and self-regulated collaborative space, which the dominant activity concerns an exchange of practical knowledge, based on an expression defended from an individual standpoint or a commented and detailed experience feedback. We maintain that the consumer forum returns spontaneously not readily identifiable consumer habits. However, the absence of an analysis model satisfying to detect these uses, gave us the opportunity to build a new reading grid, then to submit a new interpretative approach. The application of our model - to deal in depth - in a co-innovative plan, results in the construction of an offer of new contents or new situations of possible consumer habits.

Características de comportamentos de interação entre participantes em um Programa de Ensino de ler em situação de grupo

Visando aumentar o conhecimento sobre a aplicabilidade de procedimentos de equivalência de estímulos para o ensino do comportamento de ler em situação de sala de aula, um Programa de Ensino em grupo foi organizado e aplicado. Além desse, foi proposto também como objetivo descrever as características funcionais dos comportamentos de interação entre participantes e a relação entre esses comportamentos e a aprendizagem de leitura. Como material de ensino foram utilizados cartões de palavras impressas, de figuras e de sílabas. As relações entre palavra ditada e palavra impressa, a composição de palavras com sílabas diante de palavra impressa e figuras foram ensinadas em situação de grupo, combinando o procedimento de escolha de acordo com o modelo (match-to-sample) ao de exclusão. Participaram do estudo 11 crianças, pré-escolares, não alfabetizadas, com idade entre cinco e seis anos, que foram organizadas em três grupos. Para o Grupo 1 as tarefas de aprendizagem (selecionar cartões e compor palavras com sílabas) foram realizadas coletivamente e, para os Grupos 2 e 3, individualmente. Os participantes dos Grupos 1 e 3 participaram de quatro sessões nas quais puderam compor palavras com sílabas; o Grupo 2 participou de duas dessas sessões. Foram ensinadas 12 palavras e testada a leitura de outras 17 novas. 11 participantes foram capazes de ler mais de 91% das palavras ensinadas; 75% dos participantes do Grupo 1, 50% do Grupo 2 e 66% do Grupo 3 leram palavras novas. Em sessões de composição os participantes do Grupo 1 foram capazes de compor, em média, o dobro de palavras dos demais grupos. A partir de sessões de ensino do Programa filmadas, foram descritos os comportamentos de interação emitidos pelos participantes na realização das tarefas de ensino, descritos e organizados nas seguintes categorias: Realizar as tarefas consequenciadas pela professora; Realizar as tarefas consequenciadas por colegas; Consequenciar desempenho de colega; Solicitar avaliação da tarefa à professora ou ao colega; Realizar tarefa pelo colega; Olhar na direção de colega; Receber auxílio, auxiliar colegas na realização de tarefas ou Disputar materiais. Nas condições de realização de tarefas coletiva, aplicada ao Grupo 1, foram identificados e descritos 11 tipos de comportamentos de interação e, nas condições de realização de tarefa individual, foram identificados 16 comportamentos de interação. Dos comportamentos de interação descritos no Grupo 1, três eram programados e os demais oriundos das condições de ensino em grupo; nos Grupos 2 e 3, dos 16 comportamentos de interação, três eram programados. Os resultados mostraram que as condições de realização de tarefa em grupo de forma coletiva gerou contingências distintas das apresentadas na condição de realização de tarefas em grupo de forma individual. Não foi possível estabelecer relação de dependência entre a quantidade e tipos de interação e o desempenho geral no Programa de Ensino. Entretanto, os tipos de comportamentos de interação estiveram predominantemente associados às condições nas quais eles são expostos e importantes aspectos a serem considerados em futuras aplicações de procedimentos de ensino em situação de grupo.

This thesis focuses primarily on the field of European cross-border insolvency law, currently represented by the EU Regulation on Insolvency Proceedings (EC No 1346/2000). The EU Regulation considered theoretical conflict between advocates of universalism and territorialism, and is generally regarded as reflecting it in a way of modification, which is represented by distinction between main and ancillary insolvency proceedings. Determination of international jurisdiction in the main insolvency proceedings is inherently linked with the criteria of the centre of main interests (COMI), which serves as a specific connecting factor to constitute both the court with jurisdiction and applicable law, for the purpose of the whole insolvency process in accordance with the principle lex fori concursus. The COMI concept is the root of the jurisdiction trouble, thus this thesis aims at providing substantial information on the concept, since the EU Regulation neglects its proper introduction. One of many issues related to COMI conception is a phenomenon of forum shopping, term used to describe situations when debtors manipulate with facts relevant for establishing jurisdiction, in order to obtain more favourable position, usually at creditors' expense. A soiciological survey of workers' perception towards the establishment of workplace forum in South African industry: a study of Felixton Sugar Mill Industry in Kwa-Zulu Natal Province

Dissertation presented in fulfilment of the requirements for the degree of Master of Industrial Sociology at the University of Zululand, 2000. / The purpose of this study is to investigate the perception of workers towards the establishment of workplace forum at Felixton Sugar Mill Industry in South Africa. In this study both management and employees were selected to participate. This involves visiting participants in the workplace for the purposes of privacy and concentration. This helped the researcher to have an access of meeting all the respondents. In this research 30 respondents were selected from 230 employees using a simple random technique. The cluster system was also used to divide the industry into departments from which the final respondents were selected. Although 30 respondents may not be sufficient for a research of this capacity, the observation method was also used to collect and solicit the necessary information for this research. In addition to this, the researcher made use of most of the official records and statistics that were made available to her. The central view held by this study was that, workplace forums are very useful in achieving efficiency in the workplace and that they help in improving trade union activities. The critical view of the study was that there are few workplace forums established in South African industries. This has earlier been confirmed by the HRSC surveys conducted in 1997. This showed that, the industries should provide some possible measures for the establishment of the workplace forums in order to reduce industrial unrest. But the problem is that trade unions did not encourage this because they see workplace forum as a threat to them. Special attention was on workplace forum because it was taken as a second channel of representation which intended to be one of the primary instruments of the Act to democratise the workplace. The following recommendations were made: Workplace forums should be established in all industries. Trade unions should be involved in the workplace forums. There should be the prevention of the establishment of other forums within one organisation. Management and workers should work together in order to prevent impending conflict. The researcher was able to propose the following solutions for the purpose of reducing conflict in the workplace: Companies should train managers so that they can handle conflicts and maintain harmony in the workplace. The plan should be communicated and every worker should be involved. A supervisor should be concerned when an employee shows signs of serious personal stress. Companies should have a strong policy that prohibits any form of harassment or threatening behaviour. Companies should develop a crisis management team to handle violent incidents before, during and after they occur. It is hoped that the above recommendations and solutions if implemented, will bring some changes in the workplace. When that happens, the rate of conflict will show a significant decline. This will contribute towards the general enhancement of the quality of working life in industries.
