The interface between jurisdiction instruments and arbitration

This thesis addresses the question of how conventions and other instruments regulating court jurisdiction should deal with court proceedings relating to arbitration. It argues that the conventional approach of excluding court proceedings related to arbitration entirely from the scope of the jurisdiction instrument cannot be justified with reference to any international arbitration convention. It continues to argue that the exclusion of arbitration causes or exacerbates significant problems at the interface between the courts and arbitration, taking the European Union’s recent experience as an example. It then argues that the European legislature has recently directly considered the exclusion of arbitration from its jurisdictional instruments and failed to act effectively. Any amendments to this system will necessarily be offered within the relevant legal context, so an assessment of the prevailing principles in European international private law and international commercial arbitration will follow. Furthermore, the ongoing debate surrounding the delocalisation of arbitration and its relevance to the debate about the interface between court jurisdiction and arbitration shall be addressed. Finally, this thesis proposes a model for inclusion of arbitration in the European jurisdiction instrument (the Brussels I Regulation) that would, it is argued, solve or ameliorate the problems at the interface between the Regulation and arbitration, whilst broadly aligning with the prevailing principles in the relevant legal context. The thesis then considers whether this approach could be extended beyond Europe to the world at large, concluding that it could not. This work therefore takes an original approach to a topic of much contemporary controversy, by taking a holistic, rounded, and reasoned view of the problems at the interface between court jurisdiction and arbitration. It also contains original insights into several other areas, including the historical justification for the exclusion of arbitration from jurisdiction conventions, the importance of mutual trust as a founding principle of the common market, the relevance of the delocalisation debate to the topic, and the proposal for reform advanced at the end of this thesis.

IN ENGLISH Jurisdiction and Admissibility in the Czech Republic's BITs The purpose of this work is to assess whether the high number of investment cases the Czech Republic had to face was partially prompted by wordings of Czech Republic's BITs. The work focuses on clauses that pertain to jurisdiction of tribunal and admissibility of claim, as these are the first questions that are raised in every proceedings. The work consists of six Chapters. The first Chapter is introductory and outlines the issues that will be examined. The second Chapter defines the terms 'jurisdiction' and 'admissibility' and explains how the concepts relate to provisions of BITs. The third Chapter is dedicated to topic of treaty shopping. It explores cases against the Czech Republic where the issue of treaty shopping was raised, analyses the argumentation and provisions that were used in each case together with similar provisions contained in other Czech BITs, and suggests changes that should be made in order to make the clauses more effective against treaty shopping. The fourth Chapter examines the instance of parallel proceedings commenced against the Czech Republic. With existing research, it does not seem so certain that the jurisdiction is as clear cut as believed because jurisdictions must have their expertise and cannot adopt all the skills and values of an existing jurisdiction. Para tanto, parte de um apanhado histórico que abrange o desenvolvimento da political questions doctrine junto à Suprema Corte dos Estados Unidos e da teoria dos actes de gouvernment junto ao Conselho de Estado francês, até chegar ao Brasil. Após, examina como o Supremo Tribunal Federal vem enfrentando o tema ao longo dos anos, fazendo uso de três questões pontuais, quais sejam, o controle dos atos administrativos discricionários, a participação do Poder Judiciário na definição e implementação das políticas públicas e o controle jurisdicional dos processos político-disciplinares. Ao final, esboça uma solução em que se define a amplitude da atividade política do Estado e traça os limites das esferas de atribuições dos poderes do Estado, fiel ao disposto pelas normas constitucionais. / The current paper examines the field of the limits of the judicial intervention in political decisions. To do it so, it starts with a historical overview that covers the development of the 'political questions doctrine' by the United States Supreme Court and the 'actes de gouvernment' theory by the French State Council, until it arrived in Brazil. After, examines how the Brazilian Supreme Court has been deciding the matter throughout the years, using three punctual questions, namely, the control of discretionary administrative acts, the participation of the Judiciary in the definition and implementation of public policies and the jurisdictional control in political-disciplinary cases. In the end, suggests a solution that defines the amplitude of the political activity by the State and indicates the limits of attributions of the State powers, faithful to the dispositions of the Constitution.
