Theft by corporate controllers

The pillaging of companies by those who control them is becoming a common occurence in South Africa. The problem arises where those in control of a company are its sole shareholders and the property they are charged with stealing, though not legally belonging to them, is vested in an entity which itself belongs to them. One defence is that there can be no theft where the company consents to the appropriation of its funds. It is argued that a theft is committed only where all the criminal elements of the crime of theft are satisfied, notwithstanding the consent, or absence thereof, by the company. Case law indicates that a conviction depends on the : solvency or insolvency of the company; degree of control and victim of the appropriation. It is submitted that it is inappropriate to base a conviction on these criteria. All abuses of the corporate structure should be punished. / Mercantile Law / LL. M.

The applicability of a learning organisation philosophy for improving processes and practices in the Universities of Technology (UoTs) in KwaZulu-Natal

Submitted in fulfillment of the requirements for the Master of Technology Degree in Business Administration, Durban University of Technology, 2014. / The UoTs are operating in an environment in which they have to deal with multifarious and complex challenges. Responding effectively to such challenges has become critical for UoTs in achieving a competitive advantage and in outsmarting competitors. Traditional approaches which deal with rapid changes in the higher education landscape have become obsolete. The fact is that UoTs are faced with transformational challenges - increasing student intake, the need for improving throughput rate, the need for remaining financially sustainable while producing the top graduates required by industry. Given this background, this study investigates the application of a learning organisation philosophy for improving processes and practices in the UoTs of KwaZulu-Natal. Learning organisation philosophy has been identified as one of the best approaches for organisations in the corporate sector. It is used to achieve and sustain a competitive advantage. Learning organisation philosophy encourages the culture of continuous learning by members of the organisation, so as to achieve strategic objectives. This study provides UoTs’ perspectives of the learning organisation theory. Data was collected from employees of DUT. The sample was drawn from both administrative and academic employees. A self-administered questionnaire was used in collecting the data. The findings of this study reveal that the application of a learning organisation philosophy will help UoTs improve their processes and practices. Based on the findings, the majority of participants indicated that they would embrace and support the application of a learning organisation philosophy at DUT. It has to be noted that in the study, DUT was used as a case study.

Bilingual Theories and the Swedish Bilingual Profile Reflected in the Classroom : A Comparative Case-Study in two Swedish Bilingual Schools

Bilingualism and multilingualism are phenomena dominantly present in today’s globalized world. Sweden is not an exception and its international character is apparent in all domains, such as politics, business and education. English is perceived more as a second language rather a foreign one, taking into consideration the numerous bilingual and international schools of the country that promote the acquisition of Swedish and English from an early age. Teaching in bilingual classrooms may cause challenges due to students’ different linguistic abilities and background and thus, teachers are responsible to maintain a balance between both languages. The particular study has a two-fold aim; at first place, it analyzes theories of bilingualism that are directly related to pedagogical and teaching practices as well as the relation between bilingualism and brain functions. The purpose is to identify how these theories are reflected into everyday classrooms through teachers’ methods. The second part of the research is the examination of the contextual background of Sweden in terms of linguistic hierarchy, the aims of society to bilingual education and laws regarding languages and teacher training. The purpose is to outline the extent to which this background is applied into actual contexts. Therefore, the third part is the empirical study that is a comparative case-study through a qualitative approach into two bilingual schools in Sweden. The central focus is on teachers’ opinions about challenges, teaching methods and personal reflections and the identification of differences and similarities. The critical analysis of the three main parts enables the researcher to reach conclusions where certain points and issues are outlined along with possible solutions. The goal of the study is not the generalization of data but a focus on individuals and reflection of real situations that sets the basis for research in larger scales.

Herbicide Resistant Weeds: Owner/Renter Behavior and Hazard Model Analysis

Much of the literature on herbicide resistant weeds suggests that farmers do not adopt resistance management practices on rented land to the same extent as on owned land. This study uses data from the USDA Agricultural Resource Management Survey for corn and soybeans to compare adoption of resistance management practices on owned and rented land analyzing national and regional data for a variety of weed management practices. There was little support for the hypothesis that renters adopted resistance management practices less than owners. In most cases, there was no significant difference in adoption rates. In cases where there were statistically significant differences, it was more common that resistance management practice adoption was higher on rented land than on owned land. The second part of this study estimated a hazard model to predict when resistance to glyphosate would first be detected in corn fields in a state. The model was used to test hypotheses about whether adoption of different weed management practices delayed or sped up the onset of resistance. The analysis found evidence that greater use of phosphinic acid herbicides (the herbicide family that includes glyphosate) sped up the onset of glyphosate resistant weeds.

Improving Water Use in the Landscape Through Subsurface Drip Irrigation

Sustainable Built Environments Senior Capstone Project / This paper examines Subsurface Drip Irrigation(SDI) as a solution to water conservation in landscape irrigation. This is a problem because of the drought that the southwestern United States is experiencing, and the amount of water that landscapes utilize and which is ultimately wasted due to inefficient practices. Subsurface drip irrigation represents a potential solution due to its high efficiency and water saving ability; however, there are some problems within it as a system. Utilizing a multiple case studies approach, this paper looked at three of the top irrigation companies, Rain Bird, Toro, and Netafim, and examined how they innovated to overcome the problems with SDI. Synthesizing the best and most effective practices from each company, a model for improving SDI was generated.

Rethinking the history of Cypriot art : Greek Cypriot women artists in Cyprus

This thesis brings together women artists art practices situated in five key periods of Cyprus socio-political history: British colonial rule, anti-colonial struggle, 1960 Independent, the 1974 Turkish invasion and its aftermath of a divided Cyprus, which remains the case in the present day. Such study has not been done before, and for this, the current thesis aims to provide a critical knowledge of the richness and diversity of Greek Cypriot women's art practices that have frequently been marginalised and rarely been written about or researched. As the title suggests, this thesis engages in rethinking the history of Cypriot art by focusing on the art produced by women artists in Cyprus. By focusing primarily on the work of Greek Cypriot women artists I am interested to explore the conditions within which, through which and against which, women negotiate political processes in Cyprus while making art that is predominantly engaged in specific politicised patterns. The meeting point for the artists is their awareness of being women artists living in a colonised, patriarchal country under Greek Cypriot nationality. While these artists assumed very different positions in their experience of the several phases of Cyprus history, they all negotiate in their practice territorial boundaries and specific identity patterns. Significant to my thesis are a number of questions that I discuss in relation to women artists professional careers and private lives: nationalism, militarism, patriarchy, male dominance, social and cultural codes, ethnic conflict, trauma, imposed displacement through war, memory and women's roles, especially as mothers, in modern and contemporary Cyprus. Thus, I address questions of how women artists in Cyprus experienced such phenomena and how these phenomena affected both their lives and their art practices.

ESSAYS ON FRESH VEGETABLE PRODUCTION AND MARKETING PRACTICES

Commercial fresh vegetable production is one of the most rewarding and risky farming activities. The price and yield variations throughout the production year, the special characteristics of fresh vegetable produce (i.e. perishability), and the changing consumer demands are some of the factors contributing to the increased uncertainty faced by vegetable producers. This dissertation combined mathematical programming and econometric techniques to: 1) investigate the optimal production and marketing practices under different price distribution information scenarios, risk aversion levels and marketing outlets and 2) examine growers’ preferences as well the effect of risk aversion levels and growers’ risk perception on the choice of marketing contracts. Specifically, the following three modeling approaches were adopted in order to achieve the dissertation objectives: 1) quadratic programming under a mean-variance framework, 2) discrete choice experiments and 3) a combination of quadratic and integer programming embodied in a meanvariance framework. The findings indicate that optimal production practices and the resulting net returns are substantially influenced not only by the choice of marketing channel but also by growers’ risk aversion levels as well as price knowledge. Furthermore, regarding the choice of marketing contracts, the results highlight the existence of heterogeneity in preferences and illustrate the importance of certification cost, in line with the previous literature. Lastly, the findings indicate that risk aversion and risk preferences do not play a significant role in the choice of contractual agreements by farmers.

Communities of practices are particular and identified knowledge networks involved in a new global, virtual and digital framework. The study of their specific characteristics, the Legitimate Peripheral Participation and the duality Reification/Participation, provides the necessary background to understand and formalize the barriers and the limits in this new context. <br />In order to overcome these ones, the analysis of the tools and the methods for computerized reification (content analysis, information architecture, information visualization) and for enrichment and assessment of content and users (Human-Computer Interactions, Collaborative filtering) enables to develop a methodology to support the application of an automated and interactive reification process in a virtual Communities of Practices.

Business Graduates in Small Firms : Recruitment Possibilities and the Skills Gap

<p>The trend that more and more recently graduated (business) students are having trouble entering the Swedish labor market, and the fact that many of Sweden’s small firms are perfect absorbers of labor − putting aside the larger firms − how well do these two supply and demand sides match. The recurring theme of this thesis was to analyze the perceptions that small firm managers in Jönköping area, in the business-related sectors, had of business graduates and business graduate skills and competences. It was the skills approach that was the main focus of this thesis. Here we restrict ourselves to the small firms that employ less than fifty people and more than ten.</p><p>To supplement the reflections of small firm managers on graduates, soon-to-become business graduates in Jönköping area (undergraduates or postgraduates) were asked for their own opinion on small firm recruitment possibilities, and which ‘basket of skills’ they acquired and thus found to be important for small business firms. It is because of these two complementing perceptions that the authors had a chance to underline interesting graduate recruitment results, and perception on skills gaps.</p><p>The research design was of mostly qualitative nature coupled with additional integrated quantitative data serving as a supplement to the former. The empirical work was conducted through four interviews with small businesses and three focus groups with graduates.</p><p>Two of the companies had a basic aversion towards employing graduates, while one was indifferent and another welcomed graduates into the company. Graduates were seen as a ‘fresh applicant’, with new ideas and good social competence. However, lack of work experience and practicality, risks of hiring and over qualification brings the employability down.</p><p>The authors cannot identify a clear indication of a skills gap or skills match, but when taking into account the categorization of skills between practical and non-practical ones, there is a very positive skills match between graduates and small firms. In this way recommendation for designing educational business programs on the basis of practical skills seems to be appropriate for having business students well equipped for the small business labor market. In addition to that, other interesting results point out to that the skills preferences/demand by small firms varies when taking into account whether they recruit graduates to specific job posts or just for general work.</p>
