[pt] Esta dissertação analisa os fenômenos da judicialização da política e do ativismo judicial e suas consequências no cenário atual brasileiro. Há uma discussão sobre se esses ferem o princípio da separação dos poderes, sendo comprovado que o ativismo judicial pode ser responsabilizado nesse sentido. Esses fenômenos incomodam o Poder Legislativo, que pode reagir editando novas emendas constitucionais ou leis que contrapõem essas decisões proferidas pelo Supremo Tribunal Federal. O embate entre o Poder Judiciário e o Poder Legislativo levanta a questão de quem seria o detentor da última palavra, mas também pode promover um necessário diálogo constitucional em tempos de supremacia judicial. / [en] This dissertation analyzes the phenomena of the judicialization of politics and judicial activism and their consequences in the brazilian current scenario. There is a discution if these injure the separation of the powers principle, as it was proved the judicial activism may take the responsability for it. These phenomena disturb the legislative power, that may react eaditting new constitutional amendment or laws that are against these decisions told by the Supreme Court. This subject betwen the judiciary power and legislative rises the question about who world be the owner of the last word but it could also promote a usuful national constitutional dialogue nowadays.
