Ochrana osobních údajů v pracovněprávních vztazích / Personal data protection in labour-law relationschips

Valachová, Tereza January 2016 (has links)
The submitted thesis deals with personal data protection in the context of labour-law relationships. This is an actual and discussed issue in current society, which has constitutional aspects as well. Due to the extensiveness of the topic, the aim of this thesis is not giving a comprehensive explanation of the personal data protection in labour-law relationships area. My effort is to perform the reader with this issue from the general introduction including a survey of the legislation and explanation of main concepts to outlining the fundamental principles of the legislation and focusing more thoroughly on the several selected questions. The thesis itself is divided into four chapters. In my thesis I am trying to point out to the most important court decisions and also the opinions of The Office for Personal Data Protection and The Article 29 Working Party. In the first chapter I deal with the concept of privacy, because I consider it to be a "foundation stone" of the whole issue of personal data protection. This chapter demonstrates how the concept of privacy has developed in the course of time, in the next chapter the legislation of privacy protection and, as well, a conflict with other values are pointed out. In the second chapter I focus on the legislation of privacy and personal data...

Ochrana informací a osobních údajů v pracovněprávních vztazích / Information and Data Protection in Labour Law Relationships

Turoková-Hetešová, Alexandra January 2016 (has links)
Information and Data Protection in Labour Law Relationships The thesis is concerned with the issue of personal data protection in labour-law relationships, as it mainly deals with cases where the employee's right to privacy collides with employer's right to property protection. The aim of the thesis is primarily to give a complex interpretation concerning personal data protection in the context of labour law. Besides, the author attempts to solve some questions whose practical application may cause problems and draws attention to frequent bad habits that happen at workplaces. The thesis consists of four chapters which are further divided into subchapters. In the outset of the thesis the author deals with basic legal framework of privacy protection of an individual, and personal data protection as part of privacy, both in Czech legislation and in the context of international law and European Union law. Next chapters explain selected key terminology that occurs in the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the Act No. 101/2000 Coll., on Personal Data Protection and the Act No. 262/2006 Coll., Labour Code, and define basic principles that are...

Odposlech a záznam telekomunikačního provozu / Wiretapping and recording of telecommunication traffic

Frolková, Klára January 2016 (has links)
This thesis is devised as an analysis of the legal framework of the institutes of wiretapping and recording of telecommunication traffic, as well as the survey of the telecommunication traffic, which is included in the § 88 and § 88a of the act no. 141/1961 Coll., Criminal Procedure, as amended. The aim of this thesis was to analyze in detail the current and valid legal framework with respect to the protection of human rights and to point out the fact that the use of these institutes often finds itself on the threshold of considering the interference with the personal sphere of an individual to be justified/justifiable as well as the slight overstepping of such threshold by the public authorities, which I assume. The thesis is divided into four connecting chapters, not including the introduction and the conclusion. In the first chapter, which is divided into two sub-chapters, I address primarily the legal evolution of the examined institutes, as to when was the first time these institutes were incorporated into the valid legal framework and brought to life, their subsequent development and the most important amendments throughout the years. The second sub-chapter outlines the technical development from the not so distant past to the present, where I think about the evolution of technical...

Data protection in the EU - Biometric data The main aim of this thesis is to deal with the data protection in connection with the biometric data. In the first chapter, the author of this work deals with the historical context. The right to privacy even nowadays represents the solid ground of the data protection. Therefore, its de- limitation and subsequent connection with the data privacy is of an upmost importance for a proper understanding of this problematics. The author also deals with the data protection not only in the european context, but also with the disunited legislation in the US, where a legisla- tion in the context of general data protection regulation is absent. The second chapter mainly dealt with stating the general legal principles and their rel- evance to the legal order as well as with the special principles laid down in the regulation, which are mandatory to be upheld. Vybrané problémy technologické realizace evropské ochrany osobních údajů / Selected issues in technological realization of European data protection

Kubica, Jan January 2019 (has links)
This thesis focuses on the legal regulation of selected aspects of the personal data protection at the European level. Fuelled by the technological progress, this area of legal regulation is becoming increasingly important, as the usage of personal data can be source of both innovation and economic progress, but it also has the potential to negatively impact individuals` rights ("chilling effect"). The thesis analyses the usage of big data and automated individual decision making; both phenomena are assessed through principles contained in GDPR. The aim of the thesis is to, as far as these two phenomena are concerned, evaluate functionality and perspectives of the European regulation. The thesis is, apart from the introduction and the conclusion, divided into three chapters. The first part briefly introduces the concept of the right to the protection of personal data and the fundamental legal framework of the European regulation. This chapter is followed by a chapter focused on the big data, in which, after a necessary technical introduction is made, current practices of data controllers are contrasted with corresponding principles of data protection regulation. Particular attention is also paid to the pitfalls of anonymization. At the end of this chapter, it is concluded that all relevant...
