Odklony v trestním řízení / Diversions in the criminal proceedings

This dissertation provides a comprehensive account of diversions in the criminal proceedings, which constitute an important part of the modern criminal process. The introduction of the dissertation deals with the reasons for introducing of alternative ways of dealing with criminal matters into Czech criminal law and its current taxonomy. This is followed by a broad description of the development of the term "diversion" in the criminal proceedings and the current understanding of this term in Czech law (where is a plurality of opinion in this respect). In connection therewith, the author presents her opinion on the elements of a diversion, and subsequently questions, whether several instruments used in the criminal proceedings should be categorized as a diversion. The aforementioned is followed by a theoretical treatise on the international initiatives in the area of diversions in the criminal proceedings, after which the most significant milestones in the genesis of the various forms of diversion in Czech criminal proceedings are already mentioned; at the same time the constitutional and international limitations connected with these institutes are discussed. Nákupní atmosféra ve vybrané maloobchodní jednotce / Buying atmosphere in the selected retail unit

Diploma thesis deals with analysis of the shopping atmosphere of selected retail unit depending on its main objective. In the first part of the thesis - literary research - the theoretical background of the issue is processed. The second part - own work - already deals with the analysis. Retail unit Tesco České Budějovice was chosen for the analysis and a description of its shopping atmosphere is included in the work. The main method of analysis was an on-line questionnaire survey which was carried out among the customers of selected retail unit. Results of this survey served to confirmation or refutation of established hypothesis. A description of shopping atmosphere of one more retail unit was made for completeness of analysis. This description served for the purpose of comparison. On the basis of the data obtained was found that the elements of the shopping atmosphere of selected retail unit are used quite abruptly, and to a limited extent, in accordance with the strategy of focusing on low-priced on the market. Customers (with some exceptions) did not express dissatisfaction with such performing of shopping atmosphere, which suggests that customers who are shopping in this retail unit are focused more on the practical aspects of the purchase, such as low price or breadth of assortment. Four improvements for problematic areas were proposed in the work to increase the efficiency and attractiveness of the store. Areas are following: entrance area, orientation and using of colors in the store, area of counter sale and increase of using of self service checkouts.

This diploma thesis deals with the issue of creativity in the teaching of physics in elementary school. Creativity is first described in general. The reader will learn what are the aspects of creativity, what are the characteristics of creative solution of problems and how is creativity being developed in the course of live. Then, the thesis focused on the pedagogical concept of creativity. Didactic aspects of creativity teaching are presented here and creative teaching methods are characterized. Further is the work already focused on the teaching of physics itself. Besides traditional teaching methods are introduced mind maps, divergent physical tasks and advice for the realization of creativity teaching. The practical part of this thesis is the suggestion of the collection of divergent tasks and ?research probe?, i.e. the practical verification of several tasks. The tasks were given to two different groups of students, one of which had already had experience with solving these tasks, and for the second group it was something new. The results of both groups were compared and conclusions were made.

The theoretical part describes services, their characteristics and properties. It also deals with the description of tourism marketing and defines important terms related to accommodation services, as well as Yield and Revenue management. The practical part deals with the determination of the economic position of the company. In this part was used mainly statistics and own calculations, graphs and tables, and data collected from a questionnaire survey among customers, employees and the owner of the Pension. Based on the results of the questionnaire survey and hospitality trends author created proposals.

Attention is paid to dimensions and location of manufacturing areas, sanitary facilities and salesroom so that all regulations are accomplished, accessibility and manipulation with material are optimized. Building is drawn up for real estate in area of Ledenice town, which is according to development plan allocated to industrial areas. In diploma work are mentioned all important requirements, which have to be kept during project planning, requirements for documentation and also are discussed particular activities prior to construction itself.

This thesis discusses any potentialities and usage of nonverbal tasks for teaching Physics. It primarily analyses the general physical tasks and their position in teaching Physics and then nonverbal physical tasks and their application. For nonverbal tasks there is an emphasis not only on the solutions, but also on the aspects of creativity and on the advancement of divergent thinking of students. The thesis contains a set of created nonverbal tasks and their solutions. Some of tasks are processed to the worksheets and these worksheets were used for experimental verification of tasks. The experimental results are connected with this thesis and analyzed there. The aim of experiments is verification of ability of pupils to solve nonverbal tasks and their ability to identify dependencies between conventional approaches and nonverbal approaches.

The subject of this diploma thesis is the tax optimisation of a selected business entity. The thesis aims at finding the most optimum tax solution possible, especially of corporation income tax in order that the selected entity has as low tax liability as possible. The diploma thesis is divided into a theoretical and practical part, each of which is divided into individual chapters and subchapters, dealing with specific problems. The introduction of the theoretical part includes basic terms relating to tax issues, general data on the taxation system of the Czech Republic. The following and, simultaneously, most comprehensive chapter is devoted to corporation income tax, namely for the reason that the practical part deals with alternatives of optimisation of corporation income tax. In these chapters I proceeded mainly from the current wordings of tax laws and other specialised publications. The practical part of the thesis provides, one by one, suggestions of individual alternatives for reducing tax liability, which are subsequently theoretically explained and practically calculated. When calculating the individual alternatives I proceeded on the basis of exact data and details that the selected enterprise had been provided to me. Thanks to it, I had the opportunity to obtain a good knowledge of its internal functioning, economic situation but also the ownership structure. A summary of these resultant alternatives is then given in chapter 7. It exactly shows what impact each of the alternatives would have on the enterprise{\crq}s tax liability and what the tax liability would amount to if all the alternatives proposed were used.

This thesis deals with the application of narrative approach during the therapeutic work with clients with diagnosis of emotionally labile personality or dissocial defect of personality with exposure of aggression. Theoretical part of this thesis shows the basics and resources of the systemic constructivistic psychotherapy and the narrative approach as one of the main instruments for the psychotherapeutic work. This thesis also deals with analysis of some psychological views on aggression which are usually used during the therapy.Practical part of this thesis shows the basic elements of narrative approach on case studies with usage of techniques of externalisation, personification and deconstructional harking. Usage of these techniques is condition for the change of the primary client?s story which is affected by aggression. After this turnover on the new story the client is not part of the problematic system but with help of newly discovered resources he gain the ability to perceive himself as a person who is able to eliminate the effect of the aggression as a heterogeneous element and who is able to positively influence own life.
