South African retailers, who are the only players in their domestic territory, need to be aware of the economic situation and of the expansion strategies of the main international retail actors. Unlike South African retailers, international companies are experienced in the world-wide grocery retailing field and have shown a lot of determination in expanding their presence and power on an international scale. This dissertation illustrates the landscape of grocery retailing today, and the risk faced by a reactive attitude by South African retailers in the face of international competition. The dissertation provides a framework, and a complete description, for integrating merchandising activities, which include visual merchandising activities, as a crucial tool to influence consumers' buying behaviour, through their impulse buying behaviour. This research project has, as its main purpose, the identification of a relationship between merchandising activities in the grocery retailing field and the impulse buying behaviour of shoppers. The topic of this diploma thesis is the legal regulation of the Commercial Register in the Czech Republic. The thesis focuses on various problems connected with this legal sphere and with the role of the Commercial Register as a public document. The thesis consists of seven chapters, each of them dealing with different aspects of the Commercial Register's nature. At the beginning of the thesis there is the survey of the historical development of the Commercial Register and basic facts, documents and legal regulations (e. g. Code Savary 1673, Code de commerce 1807, AHGB 1863 etc.) that were very important and influencing factors for its present appearance (as it is known in the Commercial Code N. 513/1991 Coll.) are described there. Then the basic concept and principles of the Commercial Register are explained and the principle of publicity (material and formal) on which the Commercial Register is based is analyzed. The next part of the thesis illustrates the Commercial Register's structure and defines which subjects (artificial and natural persons) and information are, according to the law, recorded there. Identification of commercial items risk factors

Approved for public release; distribution is unlimited / Since the end of the Cold War, reduced budgets have limited technology growth in the defense industry making the use of Commercial Off-The-Shelf (COTS) software the accepted way to build systems. Twenty years ago, almost all DOD software-intensive systems were built by awarding large multimillion-dollar contracts to defense contractors to build systems from scratch. Consequently, with dwindling budgets, the military has recognized that they can no longer build an infrastructure independent of commercial industry. The use of commercial items does not reduce or eliminate the risks associated with the traditional development of software systems. Numerous programs have stumbled for the lack of careful consideration and identification of the unique risk factors imposed by commercial items. Even though the types of programs are diverse, there are common risk factors that can be identified from the past experiences of these programs. This thesis focuses on the critical risk factors and lessons learned associated with integrating commercial items into DOD software programs. It summarize lessons learn from programs that have made extensive use of commercial items, provides a risk checklist/questionnaire to assist PMs and developers in understanding the risks associated with their developments of a system using commercial items, and suggests mitigation strategies, which can be used as guidelines for the risk factors, to consider when adopting commercial components. The nature of rights of relief arising from a cautionary relationship

In Scots law, a creditor may enlist the aid of a third party known as a 'cautioner', who agrees to pay the creditor if the principal debtor defaults. Should the creditor see fit to sue the cautioner, the latter may seek compensation from the principal debtor for the whole amount paid or, if there are other cautioners, a pro rata contribution from the ones who did not pay. While these so-called rights of 'relief' are well established in Scottish case law, there is increasing controversy as to their nature. The present thesis engages with this problem headon, identifying the rationales for a cautioner's various rights of relief and examining how those rationales shape the content of the cautioner's claim in each case. By considering relief within the restricted confines of a cautionary relationship, the thesis aims to demystify a subject that is often complex and diffuse. It also seeks to establish the subject as a free-standing entity, independent of the historical and substantive inter-mixtures through which it has often been conceived in Scots law. After placing the cautioner's rights of relief into their private-law context (Chapters One to Five), the thesis examines each of these rights in detail. Chapter Six considers the basis of a cautioner's right to 'pro rata relief', and Chapter Seven discusses the content of that right, with particular reference to cases where there are three or more cautioners. Chapter Eight builds on the analysis in Chapter Six by determining on what basis a cautioner may claim 'total relief' from the principal debtor. Finally, Chapter Nine examines a cautioner's right to seek relief before paying anything to the creditor.
