卡債之法律分析 / The Study on debt problem of credit card in our country

本論文共分為六章，其內容架構之安排如下：第一章緒論簡述本文研究動機與目的，研究範圍與方法及論文架構。第二章分別從銀行及持卡人角度切入分析卡債問題產生的原因。第三章則著重在卡債問題的解決，以消費者債務清理條例作為時間的劃分點，由銀行自身風險控管的立場出發，再論及主管機關金管會對卡債問題的處理措施以及法院實務見解等，全面分析卡債問題的解決現況。第四章介紹美國破產法以及最新修法動態，並加以評析。第五章討論重點在於美國破產法案例選評。第六章結論部份，本文除了試著對銀行催收手段加以控管和修改破產法提出建議，期望能對當今的債務清理問題提供更妥適的解決方案外 亦整理消費者債務清理條例後，法院准許更生或清算案件的數量，分析卡奴是否因新法的制定而絕處逢生。
