區分所有權及其登記問題之研究

第一章首先說明研究內容及研究方法，以確立全篇主旨。第二章就不動產所有權之內 容，即土地所有權為配合社會變遷而為型態、內容之遞邅演變，不動產所有權中建物 、土地分別成立所有權之法律規定，區分所有權之發生演變及其理論背景，以為全篇 討論之背景資料。第三章研究區分所有權之內容分類，及專有與共同部份之界定，以 明瞭區分所有權之正確內容。第四章討論區分所有權之權利義務關係，包括結構上之 關係，利用上之關係、處分管理上之關係、及相鄰關係之法律規定及解釋。第五章我 國區分所有權之登記制度及法令解釋及目前登記制度所產生之困擾。第六章本於前述 各章所述研究區分所有權登記之優點及缺失，作成結論，以供參考。
