當國家積極保護某個法益時，反面而言，就是以限制某個法益作為保護手段，然而，刑事訴訟法踐行憲法之客觀保護義務，必須嚴守「禁止保護不足」以及「禁止過渡干預」原則。鑑於性侵害案件之特殊性，被害人當證人時，有其特別保護之必要性，但保護被害人之同時，不得過份限制被告原有之權益，因此，立法論上應建立層級化保障被害人之人證調查程序，訂定各種特殊程序之適用要件，依比例原則調和被害人與被告之權利保障，加強社政機構之介入，將相關訴訟人員之身分姓名資料保密後公開判決，並強化被害人證言之證明力，以達兼顧被害人程序保障以及被告訴訟防禦權保障之目標。
