Defesa: Curitiba, 04/04/2016 / Inclui referências : f. 103-105 / Resumo: Na última metade do séc. XX uma polêmica assumiu a preocupação central dos esforços voltados para a teoria do direito. O debate Hart-Dworkin, como ficou conhecido, envolveu uma série de autores e esforços em torno de discussões sobre a natureza do direito e a relação entre direito e moral, mas, mais do que isso, passando por questões epistemológicas sobre os limites da objetividade e a natureza e o papel da interpretação - dentro e fora do direito. A polêmica foi marcada pelos primeiros ataques de Ronald Dworkin ao pensamento positivista de H. L. A. Hart e pelas respostas positivistas em defesa do projeto hartiano ou em defesa de sua reforma. Através da exposição desse debate e das teses centrais sobre a relação entre direito e moral que dele resultaram, este trabalho busca rejeitar a tese da coerência, de R. Dworkin, assim como a tese das fontes, de J. Raz, em defesa da linha inclusivista, centrada no positivismo brando de H. L. A. Hart e na tese da incorporação de Wilfrid Waluchow e Jules Coleman. Propõe-se que o positivismo jurídico inclusivo se apresenta a meio caminho entre seus concorrentes e oferece a melhor saída aos fortes questionamentos de Dworkin que ocuparam a teoria do direito contemporânea. The Hart-Dworkin debate, as it became known, involves not just a significant number of authors and efforts around discussions about the nature of law and morality, but more than that, epistemological questions about the limites of objectivity, the nature and the role of interpretation - inside and outside the law. This controversy was first marked by Dworkin's attacks on Hart's positivist thought and later by the posivist responde in defense of hartian arguments, or advocating some kind of reform. Through the exposition of the debate and of the central theses about the relation between law and morality that resulted from it, this work aims to reject the coherence thesis, proposed by Dworkin, as well as the sources thesis, proposed by J. Raz, and defends the inclusivist approach, centered in the soft positivism of H. L. A. Hart and the incorporation thesis by Wilfrid Waluchow and Jules Coleman. This work proposes that inclusive legal positivism presents itself as a middle path between its competitors and offers the best solutions to the strong questionings, made by Dworkin, that occupied the contemporary discussions on the theory of law.
