Essa dissertação tem como objetivo analisar as autobiografias de Maria Campbell, Halfbreed, e Sally Morgan, My Place, levando em consideração aspectos de cunho histórico, político, étnico e social do Canadá e da Austrália. Além disso, a dissertação aborda a busca das escritoras por suas identidades indígena canadense e aborígine australiana, respectivamente. Para investigação do tema escolhido realizo um estudo sobre autobiografia destacando seu contexto histórico, sua relação com o sujeito autobiográfico com base em questões de gênero e etnia. Para análise das questões de gênero uso a teoria e crítica feminista, enquanto que as questões étnicas busco fundamentar na teoria e crítica pós-colonial. Para o estudo da obra de Maria Campbell entrelaço questões de cunho autobiográfico, fatores históricos canadenses e a questão da mulher indígena no Canadá. A análise de Halfbreed também busca tratar do sujeito feminino de origem métis em busca de sua identidade, igualdade e dignidade. Quanto à My Place, o processo de análise também envolveu um estudo de autobiografia a partir de uma perspectiva aborígine feminina australiana, o que trouxe à tona questões identitárias do sujeito feminino pós-colonial e questões históricas referentes à Austrália. A análise de My Place enfatiza a busca de Sally Morgan por sua identidade e pelo passado de sua família, marcado por lembranças, estórias, dor, perda e esperança. / This dissertation aims at analyzing the autobiographies by Maria Campbell, Halfbreed, and Sally Morgan, My Place taking into consideration historical, political, ethnic and social aspects of Canada and Australia. Besides, this dissertation refers to the writers search for their Indigenous Canadian and Aboriginal Australian identities, respectively. To investigate the chosen theme, I approach the autobiographical genre emphasizing its historical context, its relationship to the autobiographical subject based on gender and ethnic issues. Concerning the analysis of gender issues it was necessary to refer to Feminist theories and criticism, whereas discussions regarding ethnic issues were based on Post-Colonial theory and criticism. In the analysis of Maria Campbells work I discuss issues related to autobiography, Canadian history and to Indigenous Canadian women. Halfbreeds analysis also considers the condition of the female Métis Canadian subject in search of identity, equality and dignity. As far as My Place is concerned, the analysis was a process which involved a study of the autobiographical genre from a female Aboriginal Australian perspective. The analysis raises questions related to the identity of the postcolonial subject and Australias historical context. My Places analysis also emphasizes Morgans search for identity and for her familys past, which is marked by memories, stories, pain, loss and hope.

In August 2000, Justice O�Loughlin of the Federal Court of Australia handed down the decision in Cubillo v Commonwealth in which Lorna Cubillo and Peter Gunner took action against the Commonwealth Government, arguing that it was vicariously liable for their removal from their families and communities as children and subsequent detentions in the Northern Territory during the 1940s and 1950s. The case is the landmark decision in relation to legal action taken by members of the Stolen Generations.
Using the decision in Cubillo as a key site of contestation, my thesis provides a critique of legal positivism as the dominant jurisprudential discourse operating within the Anglo-Australian legal system. I argue that the function of legal positivism as the principal paradigm and source of authority for the decision serves to ensure that the debate concerning reconciliation in Australia operates rhetorically to maintain whiteness at the centre of political and discursive power. Specifically concerned with the performative function of legal discourse, the thesis is an interrogation of the interface of law and language, of rhetoric, and the semiotics of legal discourse.
The dominant theory of evidence law is a rationalist and empiricist epistemology in which oral testimony and documentary evidence are regarded as mediating the relationship between proof and truth. I argue that by attributing primacy to principles of rationality, objectivity and narrative coherence, and by privileging that which is visually represented, the decision serves an ideological purpose which diminishes the significance of race in the construction of knowledge.
Legal positivism identifies the knowing subject and the object of knowledge as discrete entities. However, I argue that in Cubillo, Justice O�Loughlin inscribes himself into the text of the judgment and in doing so, reveals the way in which textual and corporeal specificities undermine the pretence of objective judgment and therefore the source of judicial authority.

Bunda bunya miumba (Thundering kangaroos): dancing up a storm -- Welcome to Country: talkin' the talk -- Messing with ceremony -- 'Ethnogenesis' and the emergence of 'darug custodians' -- Conclusion. / The thesis concerns an Aboriginal community, members of which inhabit the western suburbs of Sydney at the beginning of the twenty-first century. This particular group of people has emerged as a cultural group over the last twenty-five years. In other words, the community did not exist before the advent of Aboriginal land rights in Australia. It might be right to suggest that without land rights, native title and state celebrations and inclusions of Aboriginal peoples as multicufturalism, this particular urban community would not and could not exist at all. That, however, would be a simplistic analysis of a complex phenomenon. Land rights and native title provide the beginning of this story. It becomes much more interesting when the people concerned take it up themselves. -- The main foci in the thesis are the cultural forms that this particular community overtly and intentionally produce as articulations of their identity, namely public speaking, dancing, painting and ceremony. I argue that it is only through these yery deliberate collective practices of identity-making that community identity can be produced. This is because the place that the group claims as its own - Sydney - is always already inhabited by 'us' (the dominant society). Analysis of these cultural forms reveals that even if the existence of the group depends on land rights and, attempts to attract the ultimate 'authenticity' bestowed by native title, members of this group are not conforming to native title rules pertinent to what constitutes 'genuine' 'Aboriginality' for the purposes of winning land claims. Their revived traditions are pot what the state prescribes as representative of 'authentic' urban Aboriginal culture. -- The thesis analyses the ways in which urban Aboriginal peoples are makipg themselves in the era and context of native title. In asking what this means and how this situation might have come about, the thesis seeks to respond through an ethnographic exploration of these discourses and images. The work explores problematic and polemic dominant society assumptions regarding 'culture' and 'Aboriginal culture', their synonyms and their effects. The work offers Aboriginal counter-discourses to the claim of most white locals and dominant culture that the Aboriginal people of Wilcannia have no culture. In so doing the work presents reflexive notions about 'culture' as verbalised and practiced, as well as providing an ethnography of how culture is more tacitly lived. -- Broadly, the thesis looks at what it is to be Aboriginal in Wilcannia from both white and black perspectives. The overarching concern of this thesis is a desire to unpack what it means to be black in Wilcannia. The thesis is primarily about the competing values and points of view within and between cultures, the ways in which Aboriginal and non-Aboriginal people tacitly and reflexively express and interpret difference, and the ambivalence and ambiguity that come to bear in these interactions and experiences. This thesis demonstrates how ideas and actions pertaining to 'race' and 'culture' operate in tandem through an exploration of values and practices relating to 'work', 'productivity', 'success', 'opportunity' and the domain of 'art'. These themes are used as vehicles to understanding the 'on the ground' effects and affects of cultural perceptions and difference. Litt (Melbourne and Adelaide), was an ethnologist and anthropologist who advanced from amateur status to become an important figure in the field of anthropology in Australia. He was born at Hallett in 1890. His field work was conducted in South Australia, Western Australia and the Northern Territory from 1925-1963. His published works were based on the journals and photographs he made on these expeditions. Mountford was a founding member, and later president of the Anthropological Society of SA; and founder of the Australian Anthropological Society in 1936. / 8 v. : / Title page, contents and abstract only.
