La normativa defineix els serveis de farmàcia com a unes estructures de suport per a l'ús racional dels medicaments en els hospitals, els quals exerceixen unes funcions recollides en la normativa legal. Entre aquestes funcions es troben la selecció i l'adquisició de medicaments.En el treball s'han analitzat els processos que intervenen en la selecció i en l'adquisició de medicaments, amb una anàlisi comparativa de la normativa de la Unió Europea, d'Espanya (estatal i autonòmica) i de França (estatal), amb la finalitat d'estudiar les situacions conflictives produïdes després de l'aplicació de la normativa que regula el medicament, i la problemàtica generada per l'aplicació de normatives de caràcter general (normativa de contractació pública) al cas dels medicaments, els quals tenen una regulació específica.L'objectiu final del treball és analitzar la normativa legal que regula la selecció i l'adquisició de medicaments per part dels serveis de farmàcia a Espanya, destacant els problemes que es generen en la pràctica diària, i establir un estudi comparatiu amb la situació a França. / "Comparative juridical study of the selection and acquisition of medicines by hospital pharmacy services of Spain and France"The law describes hospital pharmacy services as structures of support for the rational use of the medicines in the hospitals, which exercise some functions according to the legal regulations. Among these functions the selection and the acquisition of medicines are found.The study analyzes all the processes that intervene in the selection and the acquisition of medicines, with a comparative analysis of the regulations of the European Union, Spain (national and autonomic) and France (national), in order to study the problems produced after the application of the regulations that regulate the medicines.The final objective of the study is to analyze the legal regulations that regulate the selection and the acquisition of medicines by hospital pharmacy services in Spain, highlighting the problems that are generated in the daily practice, and to establish a comparative study with the situation in France.
