No. of bitstreams: 0 Previous issue date: 2008-12-29 / The dissertation analyses the illiterate s participation in the Brazilian democratic process, more specifically in regard of the right to vote practice, using as a basis the history of the electoral legislation from the Kingdom of Portugal ordination to the 21st century. It investigates, as well, in which level the free will to vote from these people increased their participation in the Brazilian democratic process. It observes which is the degree the electoral corruption among the schooling groups of electors; and, finally, the paper ponders to a temporary obligation of the illiterate vote. In order to reach the answers to the specifics objectives, it has been collected various text books, data from research institutes, and documents from the Electoral Superior Court of Brazil and the Electoral Regional Court of the Ceará State, Brazil. It has been also analyzed the documents and the legislation referring to the Brazilian Electoral Law. The information revealed the existence of a difference in the treatment between the literate and those who don t know how to read and write, in a way that to the first kind, voting is a civil duty and, to the others, it s a civil right, which practice depends on the each individual free will. The academic proposal points to the equalization among all people; the voting as an obligation, during a certain period of time, in order to, in a further moment, be transformed into a right for all, regardless the schooling or intellectual condition. / A dissertação analisa a participação do analfabeto no processo democrático brasileiro, mais especificamente com relação ao exercício do direito ao voto, tomando como base a história da legislação eleitoral desde as ordenações do Reino de Portugal até o século XXI. Investiga, também, em que medida a facultatividade do voto dessas pessoas ampliou a sua participação no processo democrático brasileiro. Observa qual o grau de corrupção eleitoral entre as faixas de escolaridade dos eleitores; e por fim o trabalho pondera para uma temporária obrigatoriedade do voto dos analfabetos. Para atingir as respostas aos objetivos especificados foram coletados diversos textos de livros, dados de institutos de pesquisa, acervo do Tribunal Superior Eleitoral e do Tribunal Regional Eleitoral do Estado do Ceará. Foram também analisados os documentos e legislações referentes ao direito eleitoral brasileiro. As informações revelaram a existência de um tratamento diferenciado entre os letrados e os que não sabem ler e escrever, na medida em que para os primeiros cuida-se de dever cívico e, para os últimos de um direito, cujo exercício depende da vontade individual. A proposta acadêmica aponta para a equalização entre todas as pessoas; o voto na forma de obrigação, durante determinado período de tempo, para em momento posterior, ser transformado em direito de todos, independentemente de condição escolar ou intelectual.
