On Arbitrage of Put-Call Parity:TSE Index Futures and TSE Index Options.

This research analyzes the arbitrage opportunities associated with TSE Index Futures and TSE Index Options. The results indicate that arbitrage opportunities in both markets exist even after we control for transaction costs. Arbitrage profits in both markets decrease as estimated transaction costs increase. This research also reveals that a reduction in the taxes imposed on the futures trading can increase the average arbitrage profit. Furthermore, buying futures arbitrage strategy generates a higher profit than does selling futures arbitrage strategy. Among all the selling futures strategies, the 21-due-days strategy offers the largest profit, whereas the 0-to-10-due-days buying strategy generates the highest profit among all the buying futures strategies.

Devant le ralentissement des investissements en Afrique, il s’est avéré incontournable de reconstruire un ensemble juridique moderne adapté à l’exigence de protection des activités économiques. Les Présidents des pays, essentiellement de la zone franc, ont ainsi signé le 17 octobre 1993 le Traité relatif à l’harmonisation du droit des affaires en Afrique visant à garantir la sécurité juridique et judiciaire. Le droit issu de ce traité a donné naissance à divers Actes uniformes dont l’Acte uniforme relatif à l’arbitrage. L’objectif de notre étude a été d’analyser, principalement à partir de ce texte et sa pratique, dans quelle mesure les opérateurs économiques bénéficient, par l’arbitrage, d’une meilleure garantie d’encadrement de leurs activités. Si l’arbitrage apparait comme étant un instrument pertinent en termes de protection des investissements, c’est qu’il allie deux exigences fondamentales : la liberté ainsi que la sécurité. En effet, la liberté des parties et des arbitres est au fondement de la procédure arbitrale, garantissant aux opérateurs économiques l’assurance d’une justice plus adaptée aux exigences internationales. L’arbitrage doit également offrir une sécurité juridique dans la résolution des conflits permettant de sauvegarder les intérêts des parties tout en assurant l’efficacité de la sentence arbitrale. / Faced with the slowdown in investment in Africa, it proved essential to rebuild a modern legal assembly adapted to the requirement of protection of economic activities. The Presidents of countries, mainly in the franc zone have thus signed October 17, 1993 the Treaty on the Harmonization of Business Law in Africa to ensure the legal and judicial security. Law arising from the treaty gave rise to various Uniform Acts including the Uniform Act on arbitration. The aim of our study was to analyze, mainly from the text and practice, the extent to which economic operators have, through arbitration, better guarantee of supervision of their activities. If arbitration appears as a relevant instrument in terms of investment protection is that it combines two fundamental requirements: freedom and security. Indeed, the freedom of parties and arbitrators is the basis of the arbitration procedure, guaranteeing economic operators the assurance of justice more suited to international requirements. The arbitration shall also provide legal certainty in conflict resolution to safeguard the interests of the parties while ensuring the effectiveness of the arbitration award.

Résumé : Le processus de règlement des litiges par la voie de l’arbitrage a nourri des ambitions économiques énormes dans les sphères juridiques où ce mécanisme a été instauré. L’efficacité de ce processus qui signifie entre autre un processus ayant abouti à une application, voire une exécution effective des protagonistes est un gage de la réalisation de ces ambitions. Or, ce processus peut être compromis du fait de l’annulation de la sentence arbitrale par un juge dont l’intervention dans le processus peut soit le renforcer, soit l’annihiler fondamentalement. Cette situation explique dans une large mesure les raisons pour lesquelles la doctrine juridique se place en faveur d’une collaboration solide entre la justice publique et la justice privée de l’arbitrage. Comment cette question de l’annulation de la sentence arbitrale est abordée dans les sphères juridiques du Québec et de l’Ohada? Quels sont les effets juridiques issus de la comparaison de cette situation dans chacune de ces sphères? Telle se présente la substance de cette recherche dont la méthode comparative est alimentée par le paradigme de l’herméneutique juridique et son corollaire le pluralisme juridique. Les résultats issus du dialogue comparatif devraient participer à une amélioration des situations problématiques décelées dans les sphères concernées. // Abstract : The rule process of lawsuits based on arbitration has filled out huge economic ambitions related to judicial spheres where this mechanism has been established. The efficiency of this process, which among others, has led to an application, indeed a real execution of the protagonists, is somewhat a guarantee to the fulfilment of these ambitions. However, this process can be compromised because of the cancellation of the arbitral sentence by a judge whose intervention in the process can either reinforce it or destroy it. This situation mainly explains the reasons why the juridical doctrine is in favour of a solid collaboration. How do the juridical sphere of Quebec and Ohada tackle this issue of the cancellation of the arbitral sentence? What are the juridical effects stemmed from the comparism of this situation in both spheres? The way the substance of this research appears and whose comparative method is fed by the paradigm of the juridical hermeneutics and its juridical pluralism corollary. The results stemmed from the comparative dialog should participate in improving problematic situations detected in the applied spheres.

Characteristics of Risk Arbitrage Portfolio in Taiwan

This paper examines the performance of risk arbitrage in Taiwan. Benchmarking the returns on the risk arbitrage portfolio against the CAPM and Fama-French three-factor models, the risk arbitrage portfolio produces an abnormal return of 1% per month over the period from June 1999 to April 2007. However, after adjusting for transaction costs, the returns are no longer statistically significant. On the other hand, results indicate that risk arbitrage portfolio returns are negatively correlated with market returns, and the returns tend to have a linear relationship with the market.
