O direito fundamental do consumidor em contratos de plano de sa?de : a busca de um ponto de equil?brio entre os interesses dos consumidores e das operadoras

It initiates with an introduction of the theme, in a chapter where it s analyzed the current stage of the legal science, followed by a presentation of the consumer protection as a fundamental right, of the necessity of a supplementary health system and, at the end, of an exam of the relationship existing between consumer law and health plans. In the second chapter, it continues with an analysis of the health plans contracts, from four perspectives, namely: consumer contract, regulated, of insurance nature and corporate. In the third and last chapter, it goes on with an analysis of the main subjects regarding health plan contracts which lead to lawsuits between consumers and operators. In each of these themes, are presented its controversies, followed by its jurisprudential understanding from the TJ/RS and the STJ and, at the end, reflections are traced in order to aim for a breakeven for the divergences, so that all the interests involved are contemplated and harmonized, mainly the consumer s, without, however, forgetting the sustainability that must be also guaranteed in the supplementary health system. / Este trabalho tem como objetivo analisar a incid?ncia do direito do consumidor nos contratos de planos de sa?de. Inicia-se com uma introdu??o do tema, em um cap?tulo no qual ? feita uma an?lise do atual est?gio da ci?ncia jur?dica, seguida da apresenta??o da prote??o do consumidor como direito fundamental, da necessidade de exist?ncia de um sistema de sa?de suplementar e, ao final, do exame da rela??o entre direito do consumidor e planos de sa?de. No segundo cap?tulo, ? feita uma an?lise do contrato de plano de sa?de em si, a partir de quatro perspectivas, e seus respectivos desdobramentos, para o entendimento e enfrentamento do tema, a saber: contrato de consumo, regulado, de natureza securit?ria e empresarial. No terceiro e ?ltimo cap?tulo, segue-se com uma an?lise dos principais temas oriundos de contratos de planos de sa?de que d?o azo a demandas judiciais entre consumidores e operadoras. Em cada tema, s?o apresentados os aspectos gerais de cada controv?rsia, seguidos dos entendimentos jurisprudenciais encontrados tanto no Judici?rio ga?cho quanto no STJ e, ao fim, tra?am-se reflex?es no sentido de se buscar um poss?vel ponto de equil?brio para cada quest?o, de forma a contemplar e harmonizar todos os interesses envolvidos, sobretudo o dos consumidores, sem, contudo, se olvidar da sustentabilidade que se quer (e se deve) garantir ao sistema da sa?de suplementar.
