É uma tentativa de repensar a escrita jurídica mediante o seu compartilhamento com a experiência da hermenêutica literária, elegendo-se algumas ferramentas que possibilitam indagar o sentido da verdade em jogo na tarefa de compreensão. Procura-se demonstrar que a apropriação de certas narrativas, pelo aplicador do direito, desloca a práxis interpretativa para um “laboratório experimental do humano”, propiciado pela literatura, aumentando-lhe as possibilidades de escolha e facilitando-lhe o acesso hermenêutico. Desta forma, quer-se tornar mais clara a simetria das posições reciprocamente solidárias do discurso jurídico e do literário, de forma a revelar os ‘deslocamentos circulares’ entre as hermenêuticas, que se explicitam não só no movimento dialético das narrativas que compõem o corpus e a palavra da lei, como também na interação entre os discursos envolvidos no jogo da compreensão. __________________________________________________________________________________________ ABSTRACT / The objective is to investigate the gears that allow comprehending law– literature relationship, by analyzing the problem of dialogical inter-relationship between juridical and literary texts. It is an attempt of rethinking juridical written, by means of sharing it with the experience of literary hermeneutics, electing some tools that allow inquiring the sense of the truth being judged in the task of comprehension. The intention is to demonstrate that the appropriation of certain narratives by the law executor dislocates interpretative praxis to a “human experimental laboratory”, propitiated by literature; which increases possibilities of choices and eases hermeneutic access. Thus, the aim is to clarify the symmetry of the reciprocally solidary positions of juridical and literary discourses, revealing the ‘circular displacement’ among hermeneutics. This gets explicit not only in the dialectical movement between those narratives and the word of law, but also in the interaction among discourses evolved in the game of comprehension.
