An Interrupted Time Series Analysis of the State College Nuisance Property Ordinance and an Assessment of Rental Property Managers as Place Manager/Intimate Handler of OffenderKoehle, Gregory M. 16 August 2011 (has links)
This research involves a legal impact study of the State College Nuisance Property Ordinance and an assessment of State College Rental Property Managers in the role of place manager/intimate handler of offender. The impact of the Ordinance was assessed by employing an interrupted time series design which examined five years of pre-ordinance violations against five years of post-ordinance violations. The assessment of State College Rental Property Managers in the role of place manager/intimate handlers of offenders was assessed through a mail survey. The survey contained items that measured the level to which State College Rental Property Managers have assumed this role. This level was then regressed against the offenses covered under the Ordinance in order to determine if this role has an impact on reducing and/or deterring offenses in rental units. The data suggest that the Ordinance was successful in reducing violations in nuisance rental units. In addition, the analyses of the survey revealed that a higher level of place manager/intimate handler of offender was positively correlated with criminal and ordinance violations. / Dr. Randy L. The Influence of Civil Remedies and Proceeds of Crime Grant Programs on Canadian Streetscape Camera Surveillance Systems: Lessons from Six Cities in OntarioMahon, Denise 06 May 2014 (has links)
This thesis explores the influences of provincial grant programs on Canadian streetscape camera systems. Using qualitative interviews (N=32) and document analysis, the study explores the policymaking processes and outcomes of six Ontario cities that have engaged with the Civil Remedies and Proceeds of Crime grants. Grant programs have not only provided the financial support to facilitate the establishment or expansion of camera systems, but they have also encouraged particular patterns of implementation, design and operation of Canadian streetscape systems through the processes and conditions of the grant program, as well as through the encouragement of regional networking, policy learning and policy diffusion via policy tourism. While the Civil Remedies and Proceeds of Crime grants have influenced some similarities in streetscape camera systems, variation exists, particularly concerning privacy policies, due to idiosyncratic interpretation and adoption of diffused policies and an ambiguous and unclear privacy protection framework. / Graduate / 0626 / 0627 / dennymah@uvic.ca

The trustee has a fiduciary responsibility towards the parties with an interest in the trust.
The parties with an interest in the trust may have certain expectations and requirements of the trustee. The main responsibility and accountability ascribed to and expected of the trustee are for the proper maintenance and administration of the trust and its assets.
The parties with an interest in the trust may be classified according to how closely involved or affected they are by the existence of the trust. The parties closest to the trust are listed as the founder, beneficiaries and co-trustees. Parties with a judiciary, legislative and administrative interest in the trust include the Master of the High Court, the High Court and the auditors as well as accountants of the trust.
The parties with an interest in the trust may not be satisfied with the actions or performance of the trustee. These parties may seek actions and remedies to hold the trustee accountable. These actions and remedies may be found in legislation, the literature, common law or court judgements. It would also be in the trustee’s interest to be informed of the different actions and remedies that could be utilised to hold him accountable.
Different types of action are available to hold the trustee accountable, including civil and criminal remedies. The Trust Property Control Act 57 of 1988 does not provide for criminal remedies, but provides an array of civil remedies to hold trustees accountable. The Aquilian action is also available to parties to hold a trustee accountable who committed a breach of trust.

Teikiamuose mokslo darbuose, remiantis kitų valstybių, Lietuvos doktrina ir teismų praktika analizuojama ir aiškinama teisinio reguliavimo novelų esmė, pateikiamos tam tikro instituto ar dalyko fundamentalios žinios ir vertinimai. Atsižvelgiant į tai, kad, ypač intelektinės nuosavybės teisės srityje, dauguma analizuotų klausimų susiję su Europos Sąjungos ar tarptautinės teisės aktų nuostatų įgyvendinimu vidaus teisėje, analizuojami šio įgyvendinimo rezultatai, nagrinėjamos atitinkamų nuostatų turinys ir taikymo galimybės, atskleidžiamos tinkamo ir netinkamo teisės taikymo atvejai, doktrininiu aiškinimu šalinamos esamos teisinio reguliavimo ar teisės taikymo spragos arba klaidos. [toliau žr. visą tekstą] / The subject matter of the scientific studies comprises a study of key issues of the protection of copyright as well as enforcement of other intellectual property rights. The basic methods of study used in the works are comparative, historical and teleological. The model of legal regulation of the protection of intellectual property rights chosen is the one existing in the states of droit d’ auteur and copyright systems, and based on this model the key issues of copyright protection are analysed by way of comparing and assessing the aspects provided for in the Lithuanian legislation.
Lithuania follows the droit d’ auteur system. In general, the Lithuanian copyright law does not reflect any unique tradition. The development of intellectual property rights protection in Lithuania essentially coincided with the accession to international and regional organisations and to international agreements. When Lithuania decisively implemented one of its foreign policy aims — to become a member of the European Union — the approximation of its national law to the European Union legislation commenced in the field of intellectual property law as well as in the whole legal system.
