Náhrada nemajetkové újmy u tzv. sekundárních obětí / Compensation for a non-pecuniary harm of secondary victims

Přenosilová, Klára January 2017 (has links)
This final thesis "Compensation for a non-pecuniary harm of secondary victims" deals with the issue of secondary victims. A secondary victim is defined as an injured person who suffered a non-pecuniary harm as a consequence of what happened to another person (primary victim) to which the tortfeasor caused imminent harm. I focused exclusively on secondary victims under the section 2959 of Czech Civil Code. The section 2959 of Czech Civil Code enables secondary victims to require a monetary compensation for the harm which they suffered as a consequence of a death or a serious injury of their close person (primary victim). Within the analysis of section 2959 of Czech Civil Code I described the nature of a harm suffered by the primary victim, the circle of eligible secondary victims and the quality of their harm, as well as the extent of the compensation for the harm of secondary victims. Doing so, I used the comparative method. I compared the legal regulation of the Czech Civil Code with the former Czech regulation and corresponding decisions of Czech courts. For the purposes of international comparison, each chapter includes a part of the legal situation of secondary victim (close person) under the Austrian law. The analysis showed that the new regulation under Czech Civil Code improved in general...

Diskurzivní pravidla spojené s umíráním: Jak lidé hovoří o smrti blízkých / Discourse Rules Connected to Dying: How People Talk About Death of Close Ones

Exnerová, Dominika January 2016 (has links)
The thesis aims with discourse rules of dying of a close person. Author works with other theories, especially with Gorer's pornography of death and also comparisons of current situation and history of Ariés and Elias, who considered the current representations of death to be more a taboo than in the past. The practical base of the text is a research combining both in-depth interviews with young people and interpretations of closed groups, such as support group and internet discussion. The analysis identified two approaches in young people's families, focusing either on practical aspects of dying of a relative or on emotional aspects. These two approaches were in opposition against each other especially while both being present in a single family. Also, several conditions changing discourse rules were identified. The death of a young person or by suicide were more tabuized than death of an elder person. Generally, the research shows that people's view on death is not constructed by media as Gorer proposed, since young adult people have their own experience from their families. In this text, death is considered to be a taboo of the society because of strict boundaries of what is appropriate and inaproppriate. Powered by TCPDF (www.tcpdf.org)

Náhrada nemajetkové újmy sekundárních obětí / Compensation for a non-pecuniary harm of secondary victims

Zielina, Dominik January 2018 (has links)
ABSTRACT! ! ! In the present thesis, I focus on the comprehensive legal framework for the legal instrument of compensation for non-pecuniary harm that was sustained by secondary victim(s), i.e., a person or persons not affected directly who are close relatives to primary victims, differing from primary victims whose interest is secured by article 2958 of the Civil Code (designated as smart money and compensation for aggravation of social position). It is these secondary (indirect) victims who sustain non-material harm through mental suffering that is a natural reaction to the death or grave injury of the primary victim who is their close relative. They are also provided for by law by means of the special provision of article 2959 of the Civil Code, which allows them to seek adequate pecuniary settlement from the offender, aimed at mitigating the pain upon either the loss of a close relative or their permanent and irreversible grave impairment that requires permanent care. ! ! First of all, I produced a thorough analysis of the specific legal instrument in its current legal arrangement; then, I compared this arrangement to that of the 1964 edition of the Civil Code. In particular, I defined legal reasons for the inception of this pecuniary compensation, particular the criteria for objective assessments,...
