Trata este estudo acerca da regressão do cumprimento da pena em regime semiaberto, na comarca de Porto Nacional. A pena privativa de liberdade é uma imposição acrimoniosa, mas necessária. Não se busca a sua abolição, mas refletir sobre o cumprimento das funções basilares de retribuição e reintegração social do apenado. O que a sociedade pretende fazer com o indivíduo que, ao cometer uma conduta criminosa quebra o pacto social, atraindo para si a vingança pública, ao passo que somente ao Estado cabe punir, sendo intolerável a vingança privada? É certo que o sistema prisional funda-se na promessa de reintegrar o preso à sociedade. Esta dissertação dedica os seus dois últimos capítulos para demonstrar a falsidade dessa promessa e apontar sugestões viáveis que atenuem os efeitos deletérios da omissão do Estado. No primeiro capítulo realiza-se um acercamento histórico da pena desde a idade primitiva à contemporânea, dando ênfase à história penal do Brasil e Porto Nacional. No segundo capítulo analisa-se o perfil dos reeducandos que cumprem pena no regime semiaberto na Cadeia Pública de Porto Nacional, confrotando com o levantamento feito pelo Ministério da Justiça, a nível nacional e estadual. Nos últimos capítulos realiza-se um estudo e reflexão sobre a falência da reintegração social dos apenados, conforme demonstrado pela elevada taxa de reincidência penitenciária e das fugas, como causa principal da regressão de regime semiaberto. / This study is about the regression of the fulfillment of the sentence in semi-open regime in the region of Porto Nacional. The penalty of deprivation of liberty is an acrimonious but necessary imposition. Its abolition is not sought, but to reflect on the fulfillment of the basic functions of retribution and social reintegration of the distressed. What society intends to do that by committing a criminal conduct breaks the social pact, attracting public revenge for itself, whereas it is only the State that has to punish, and private revenge intolerable? It is true that the prison system is based on the promise of reintegrating the prisoner into society. The present dissertation devotes its last two chapters to demonstrate the falsity of this promise and to point out viable suggestions to mitigate the deleterious effects of the omission of the State. In the first chapter there is a historical approach of the penalty from the primitive age to the contemporary age, emphasizing the criminal history of Brazil and Porto Nacional. In the second chapter, the profile of the re-educators who serve their sentence in the semi-open regime in the Porto National Public Prison is analyzed, comparing with the survey done by the Ministry of Justice at national and state level. In the last chapters, a study and reflection on the bankruptcy of the social reintegration of the prisoners is carried out, as demonstrated by the high rate of penitentiary recidivism and fugues as the main cause of the regression of the semi-open regime.
