Participant d'un mouvement global d'élaboration du droit par des organismes privés, la Fédération Internationale des Ingénieurs Conseils (FIDIC) élabore et diffuse les contrats FIDIC. Il s'agit de contrats-types utilisés dans les grands projets de construction internationaux par les acteurs du secteur de la construction internationale. Les contrats FIDIC participent à la transnationalisation du droit applicable à ces projets. Cette transnationalisation pose la question de l'existence d'une lex constructionis, dérivée spécifique de la lex mercatoria.Pour répondre à la question de l'existence de la lex constructionis, l'auteur procède à l'étude de la formation et de l'application des contrats FIDIC. / The FIDIC ContractsThe International Federation of Consulting Engineers (FIDIC), participating in a global trend of creation of the rule of law by private organizations, elaborates and issues the FIDIC contracts. These contracts are standards widely used in major international constructionn projects by the main actors of international construction market. The FIDIC contracts participate to the transnationalization of the applicable law to such major projects. This transnationalization raises the question of the existence of a lex constructionis, a specific derivative of the lex mercatoria. In order to answer the question of the existence of the lex constructionis, the author procedes to the study of the formation and the application of the FIDIC contracts.

Legal standing of neighbours in the procedures under the Building Act The diploma thesis deals with the legal position of neighbours in procedures under the Act No. 183/2006 Coll., on Spatial Planning and Construction Regulation (Construction Act). Although the neighbour is one of the most affected parties in the construction process, the term 'neighbour' itself is not defined in the legal order. The aim of this work is to clarify who is considered to be a neighbour for the purposes of the Construction Act and what legal status does this person have in individual procedures under the Construction Act, including the analysis of possible procedural means to protect his/her rights and legitimate interests. The thesis also points out the legal aspects of the construction process as a comprehensive procedure characterized by a chain of separate and usually successive procedures. In these procedures, the Construction Authority must not only take into account the various public and private interests in the territory, but should also be able to assess the construction project in question not only in terms of construction law but also in terms of civil law. A Comprehensive Practice of Total Float Pre-Allocation and Management for the Application of A CPM-Based Construction Contract

Many construction contracts require contractors to use the Critical Path Method (CPM) scheduling technique as a management tool. In such projects, many participating parties commonly attempt to appropriate float time shown in the CPM schedules in order to advance their own interests. Under current scheduling practices, float time is considered "free" and therefore does not belong to any one party in the construction process. As a result of this conception, when a project delay occurs, float ownership and its utilization can become a major source of dispute. This ambiguous interpretation of total float ownership can be clarified by improving contract language with regard to scheduling specifications in the area of total float management. The purpose of this research dissertation is to introduce a comprehensive practice of float pre-allocation and management terms, for the application of scheduling specifications in the CPM-based construction contract. The proposed concept for managing "total float" involves pre-allocating a set amount of total float on the same non-critical path of activities to the two contractual parties - owner and contractor. For the sake of equity, this research adopts an equal (50-50) allocation concept, which allocates to each party one-half of the total float. This new concept for pre-allocating and managing "total float" involves recommending contract clauses to direct its use and to explain the manner in which responsibility for any resulting delay will be assigned. Six examples of factual situations are provided to illustrate the assigning of responsibility for delays. The features of proposed concept are then compared to those of other theories presently being used. Such a comparison provides insight as to which features have not worked well in the past - and how those of the proposed concept can change this. A Delphi survey is used to validate the total float pre-allocation concept of equal allocation. The survey shows that the concept could significantly increase involved parties' awareness of total float consumption and thus help resolve any potential disputes regarding it. This dissertation considers suggestions obtained from the survey and recommends them for future study. The simple step of inserting new scheduling language into the construction contract documents assures that all participants will become more aware of the fact that when they consume floats, they introduce the potential of increasing project completion times. / Ph. Therefore, from the historical conception of civil procedure, from its birth to the paradigm shift with the emergence of mass action, reflected about the best techniques that were able to make the mass right as a model process other than the individual and the collective. Introduced the notion of a process of practical results from the rereading of the procedure for different cases in order to occur a greater rationalization of the judgments. Also discussed was the use of judicial precedents and its variants as a means of unification of the jurisprudence, which denotes closer to family law in the Common Law. After the demonstration of such assumptions, concluded that it is possible to construct a particular dogmatic for mass actions, as crucial to ensure greater legal certainty in the solutions of similar cases. / Esta dissertação se propõe a uma investigação científico-dogmática das demandas relativas às teses repetidas, isto é, de mesma fundamentação jurídica. Para tanto, a partir da concepção histórica do processo civil, desde o seu nascimento até a mudança de paradigma com o surgimento das ações de massa, refletiu-se a respeito da descrição das melhores técnicas, tendo sido várias delas já inseridas em nossa legislação, para que assim se realize o direito de massa como um modelo de processo diferente do individual e do coletivo. Introduziu-se a noção de um processo de resultados práticos a partir da releitura do procedimento para casos diferenciados, de modo a ocorrer maior racionalização dos julgamentos. Também foi analisado o uso dos precedentes judiciais e suas variantes como meio de unificação da jurisprudência, o que denota maior aproximação ao direito de família do Common Law. A partir da demonstração de tais premissas, concluímos que é possível a construção de uma dogmática própria para as ações de massa, pois crucial para garantir maior segurança jurídica nas soluções de casos análogos.

Render Unto Caesar: How Misunderstanding a Century of Free Exercise Jurisprudence Forged and Then Fractured the RFRA Coalition

This thesis provides a comprehensive history of Supreme Court Free Exercise Clause jurisprudence from 1879 until the present day. It describes how a jurisdictional approach to free exercise dominated the Court’s rulings from its first Free Exercise Clause case in 1879 until Sherbert v. Verner in 1963, and how Sherbert introduced an accommodationist precedent which was ineffectively, incompletely, and inconsistently defined by the Court. This thesis shows how proponents of accommodationism furthered a false narrative overstating the scope and consistency of Sherbert’s precedent following the Court’s repudiation of accommodationism and return to full jurisdictionalism with Employment Division v. Smith (1990). It then shows how this narrative inspired a massive bipartisan coalition in favor of codifying accommodationism, and how this coalition succeeded in passing the Religious Freedom Restoration Act (RFRA) in 1993. The RFRA coalition eventually fractured, as RFRA’s implications began to conflict with principles and objectives of liberal interest groups and the Democratic Party. This thesis posits that the fracture of the RFRA coalition can be traced back directly to confusions over Sherbert’s precedent.

This thesis deals with joint procedure to grant planning and building permission. The thesis' aim is to summarize the legal development of the joint procedure to grant planning and building permission between the years 2007 and 2018 and to focus on its problematic aspects, which are relevant in legal regulations, and subsequently to describe the possibilities for their appropriate solution. The sub goal of this thesis includes the outline of possible changes in connection with an envisaged recodification of the Czech Public Construction Law, in which the joint procedure to grant planning and building permission plays a key role. Dans plusieurs Etats membres de lUnion européenne, des dispositions particulières ont été adoptées, en marge du droit de la construction et de la promotion immobilière, pour assurer une protection particulière au consommateur dans le secteur du logement. Pour un juriste européen, cette observation conduit à sinterroger sur les perspectives dharmonisation du droit de la construction et de la promotion immobilière, puisque la politique de protection des consommateurs constitue désormais une compétence législative autonome de lUnion européenne. Dans cet ouvrage, lauteur, après avoir rappelé le contexte de lharmonisation du droit privé dans le secteur de la construction, exprime sa préférence pour une harmonisation spécifique, limitée du moins dans un premier temps au seul secteur résidentiel. Aussi procède-t-il à la comparaison des mesures de protections dont bénéficie le consommateur, en droit de la construction et de la promotion immobilière, dans différents Etats membres de lUnion européenne ; une attention particulière est portée aux mécanismes dautorégulation, qui, dans certains pays, résident au cur de lorganisation de la protection du consommateur de la construction.
