This thesis in its first part deals with the complexity of the legislation, which is related to design activities and also trying to explain the basic rules for the creation of project documentation. In the main section then analyzes and evaluates the selected drawing software in defined categories. Based on the selection chooses the best drawing software and compared with the hand-crafted version of the design documentation in terms of time and cost. The final time for the creation of project documentation will be converted to a built-up area of the building and found the relationship between time constraints and the size of the built-up area of the new building. It will also be evaluating the return on investment to drawing software and assessing cost-effectiveness of various options drawing. The aim of this thesis is to analyze the risks in the use of software products for structural design and evaluate their use based on the value of work.

Cooperative Construction in Schools in California John M. Donley The construction industry has lost efficiency since 1964, while becoming increasingly more litigious. Schools in California can ill afford the time to allow the construction industry time to fully evolve. It may take years or decades to fully improve the efficiency of, and reduce the conflict within the construction industry. At the same time, the construction industry has developed new processes to improve efficiency and reduce conflict. These processes are beginning to be broadly embraced by the industry. They all contain cooperative elements. Taken together they represent a new organizing principle for the construction industry, cooperative construction. Also concurrently, a previously little-used provision of the California Education Code allows schools freedom to contract for school construction in nearly any reasonable contractual arrangement they see fit for their project and district needs. As a result, school districts in California have developed a new system of project delivery. They are borrowing from here and there and inventing new tools to make projects work for them. Again, cooperative elements at the hearts of the processes.

土木技師公會係依政府法令規定而由具有執業土木技師資格者為會員組成之社團法人組織,兼具業務服務與非營利組織雙重的特質。由於執業權受環境的影響,土木技師公會自成立以來即不斷與政府法令抗爭,目前收入最大宗的現況鑑定業務,也面臨了激烈的競爭環境。 本論文採Aaker策略市場管理模式,綜合Glueck提出之策略規劃架構,以個案研究方式,選擇台北市土木技師公會作為研究對象,探討個案公會目前面臨問題及可採行之經營策略,獲得結論如下: 1. 土木技師公會現況鑑定業務經營之關鍵成功因素為良好的人脈關係、良好的工作品質、良好的社會形象及良好的價格優勢。 2. 因環境改變,個案公會面臨現況鑑定業務的減少。 3. 外在環境仍讓個案公會會員之執業權受限。 4. 宜要求政府立法成立一專責機構負責推動全國土木建設事宜。 5. 個案公會業務宜採穩定策略,保障執業權宜採擴張策略。 文最後對個案公會可採行策略方案提出建議,另外對土木技師公會面臨問題、政府作法及後續研究方向也提出建議,以供後續研究者參考。

Anläggningsprojekt är idag allt fler på grund av att den infrastruktur som byggdes på mitten på 1900-talet inte längre uppfyller dagens ställda krav. I takt med att större entreprenader utförs idag, krävs även större resurser och bättre samspel mellan beställare och entreprenörer. Entreprenadsumman för ett betongbroprojekt är väldigt stark förknippat med mängden ÄTA–arbeten och avvikelser. ÄTA–arbeten kan gå i olika riktningar, till exempel från underentreprenör mot beställare och tvärtom. I denna studie ligger fokus på entreprenörens ÄTA–arbeten gentemot beställaren och avvikelser som uppstår i produktionen. Syftet med studien är att identifiera de vanligaste ÄTA–arbeten och avvikelser som förekommer i olika betongbroprojekt för att undersöka hur dessa påverkar entreprenadsumman samt hur de i framtiden skall hanteras av entreprenören så att de inte upprepas i kommande projekt. Till en början har en litteraturstudie gjorts för att öka kunskapen kring ämnet. Därefterhar en fallstudie utförts av fyra tidigare betongbroprojekt. Den centrala delen av fallstudien har varit en kvalitativ undersökning, med intervjuer samt en enkätundersökning. Det har hållits 10 intervjuer med olika platschefer, en jurist och en arbetschef, samtidigt har 55 tjänstemän från fallföretaget deltagit i enkätundersökningen. I den kvantitativa delen har en sammanställning gjorts av samtliga ÄTA–arbeten och avvikelser som uppstått i de betongbroprojekt som studerats. Därefter har de ÄTA–arbeten och avvikelser som upprepats i dessa betongbroprojekt identifierats. Studien visar att ÄTA–arbeten oftast uppstår på grund av brister i beställarens förfrågningsunderlag. Geotekniska undersökningar och tekniska lösningar föreskrivna av beställaren är det som vanligen föranleder ÄTA–arbeten. Även entreprenadformen är avgörande för mängd och typ av ÄTA–arbeten. I en utförandentreprenad är det mycket mer likställda ÄTA–arbeten och när det gäller en totalentreprenad är de vanligaste ÄTA–arbetena föreskrivna tilläggs- och ändringsarbeten. Det är sällan lönsamt med många ÄTA–arbeten i betongbroprojekten, däremot ökar det projektensomsättning vilket får ses som positiv. Avvikelser förekommer oftast på grund av dålig planering och kommunikation. Bristfälliga arbetsberedningar och missade kontroller är andra orsaker till att avvikelser förekommer. Det är oftast entreprenörens eget fel attdet uppstår avvikelser. Avvikelserna har då alltid en negativ inverkan på projektetsslutkostnad i och med att kostnaden inte läggs på entreprenadsumman, det vill säga att entreprenören avhjälper avvikelser på egen bekostnad. De vanligaste ÄTA–arbetena förekommer kring brokonstruktionens grundläggning,oftast på grund av att de geotekniska undersökningar som gjorts, har gjorts fel eller inte i tillräcklig omfattning. När det kommer till avvikelser är de vanligast i samband med armeringsarbeten och betonggjutningar. Dyrare avvikelser förekommer men inte i någon större utsträckning. Genom att lägga mer fokus på planering, kommunikation, involvering och upprätta bättre arbetsberedningar kan negativa effekter på entreprenadsumman på grund av ÄTA–arbeten och avvikelser undvikas. / Various plant projects are today more common because the infrastructure built in themid-1900s no longer meet today's set requirements. As major contracts are carried out today, greater resources and better interaction between client and contractor are also required. The contract sum for various concrete bridge projects is very strongly associated with the amount of contract changes and deviations. Contract changes can go between different entrepreneurs for example from a subcontractor against the clientand vice versa. In this study the focus is on contract changes from the main entrepreneur towards the client and deviations that occurs in the production. The purpose of the study is to identify the most common contract changes and deviations that occur in different concrete bridge projects to investigate how these affect the contract sum and how they should be handled by the entrepreneur in the future so that they are not repeated in upcoming projects. Initially a literature study has been done to increase knowledge about the subject. Then a case study has been carried out on four previous concrete bridge projects. The central part of the case study has been a qualitative investigation, where interviews have been held and a survey has been conducted. There have been 10 interviews with various site managers, a lawyer, and a supervisor, while 55 officials from the case company have participated in the survey. In the quantitative part, a compilation of contract changes and deviations that has occurred in the concrete bridge projects that was studied has been done. Then the contract changes and deviations that was repeated in all the studied concrete bridge projects has been identified. The study shows that contract changes occur most often because of deficiencies in the clients request documents. Geotechnical investigations and technical solutions prescribed by the client are what usually prompt contract changes. The contract form is also crucial for the amount and type of contract changes. In a contract that is based on AB 04 it is much more preserved contract changes and when it comes to a general contract based on ABT 06, the most common contract changes are prescribed alterations and additional works. It is rarely profitable with many contract changes in concrete bridge projects, yet it increases the revenue of the projects, which may be positive. Deviations occur most often due to poor planning and communication. Inadequate work preparations and missed controls are other reasons for the presence of deviations. It is usually the entrepreneur’s fault that there are a lot of deviations. Deviations always has a negative effect on the project’s final cost since the cost for it is not added to the contract sum, which means that the entrepreneur remedies deviations at their own expense. The most common contract changes occur around the groundwork of the bridge construction, usually because the geotechnical investigations carried out by the client, have been done wrong or not enough. When it comes to deviations the most common are in connection with reinforcement work and concrete castings. More expensive deviations occur but not to a greater extent. By focusing more on planning, communication, involvement and establishing better work preparations, negative effects on the contract sum due to contract changes and deviations can be avoided.

Ce mémoire traite comme objet le BIM (Bâti immobilier modélisé), ses incidences et ses perspectives juridiques dans le droit de la construction au Québec, il consiste à présenter une discussion méthodologique relative à ce sujet. Le BIM et la disposition de l’ensemble des informations sur une maquette numérique globale pourraient éventuellement élargir les hypothèses de mise en jeu des responsabilités des intervenants ainsi que le partage des risques. Pour le savoir, nous jugeons opportun de pouvoir dresser un panorama des risques et responsabilités des participants d’un projet de la construction pour permettre de tirer les changements ainsi que les conséquences juridiques de l’arrivée de ce processus dans l’industrie de la construction. Il est donc nécessaire d’analyser le cadre juridique actuel afin de déterminer l’applicabilité du régime de responsabilité civile aux intervenants BIM, au regard du droit de la construction et des dispositions du Code civil du Québec, par la même occasion, de conclure si un changement des dispositions législatives est nécessaire ou non. Ce travail traite également les difficultés juridiques inhérentes à l’utilisation des modèles BIM, notamment les risques technologiques et les questions des droits d’auteurs des éléments de la maquette numérique. Enfin, cette recherche dresse une présentation sur les outils juridiques à déployer et offre également une approche pragmatique des pratiques contractuelles actuelles du BIM au Québec en présentant les différents documents contractuels le concernant. / This study treats as an object the BIM (Building Information Modeling), its implications and its legal perspectives in the construction law in Quebec, it consists in presenting a methodological discussion relating to this subject. BIM and the provision of all the information on a global digital model could possibly broaden the hypotheses of bringing into play the responsibilities of the parties involved as well as risks sharing issues. To find out, we believe it is appropriate to be able to draw up an overview of the risks and responsibilities of the participants in a construction project to allow us to draw the changes as well as the legal consequences of the arrival of this process in the construction industry. It is therefore necessary to analyze the current legal provisions in order to determine the applicability of the civil liability regime to BIM stakeholders, with regard to construction law and the provisions of the Civil Code of Quebec, at the same time, to conclude whether a change in the legislative provisions is necessary or not. This research also deals with the legal difficulties inherent in the use of BIM models, in particular the technological risks, data ownership and associated proprietary issues of the elements of the digital model. Finally, this paper presents the legal tools to be deployed and also offers a pragmatic approach to the current contractual practices of BIM in Quebec by presenting the various contract documents.

Le secteur de la construction constitue un pan majeur de l'activité économique qui sous-tend une large part de la croissance au plan national. Partant de ce constat, il a semblé opportun de s'intéresser plus particulièrement aux marchés de travaux privés et plus précisément encore à la question du paiement. Au coeur des relations économiques, le paiement défini comme l'exécution d'une obligation porte en son sein la question fondamentale de sa sécurisation. Préoccupation légitime du créancier, on trouve sa pleine consécration et son traitement le plus abouti en droit civil dans le droit des sûretés qui occupe le livre IV du Code civil. Toutefois, dans les marchés privés de travaux, la sécurisation du paiement est rendue possible tant au stade de la formation du contrat par la détermination de son objet - le prix - qu'au stade de l'exécution grâce aux modalités de l'opération de paiement elle-même et à la fourniture de garanties. Appréhendant l'opération de paiement tant d'un point de vue pratique que théorique, l'objet de la présente thèse est de montrer que la sécurisation du paiement dans les marchés privés de travaux peut être envisagée tant au stade de la formation que celui de l'exécution du contrat. / The construction sector is a major pan of economic activity that underlies much of the growth nationally. With this in mind, it seemed appropriate to focus specifically on private works contracts and even more specifically to the issue of payment. At the heart of economic relations, payment defined as fullfilment of an obligation is asking the question of its security. In private works contracts, securing the payment is possible both during the formation of the contract by the determination of its purpose - the price - at the stage of execution thanks to the operation of arrangements payment itself and the provision of guarantees. Apprehending the payment transaction from both a practical and theoretical, the subject of this thesis is to show that the security of payment in private building contracts can be considered both during training than the contract.

Environmental protection within specific proceedings pursuant the Building Act Unrestrained construction activity damages natural resources and diverse environmental components in irreversible or in difficult-to-repair ways, thereby further thwarting thriving or even surviving of the World population. In the Czech legal system, the regulatory measures of administrative bodies, along with the participation of the affected stakeholders, contribute to the environmental protection of the individual development project. This dissertation examines the methods, means, and tools of environmental protection within the framework of designated proceedings regulating the construction. Specifically, it analyzes the possibilities of implementing protective environmental measures within the construction-permitting procedures enshrined in the provisions of Sections 103 to 117 of the Building Act. Five construction-permitting regimes are examined separately: the building permit process; notification; public law contract; notification with certificate of the authorized inspector and projects requiring neither building permit nor notification.
