Paslaugų sutartys: CK ir DCFR palyginimas Paslaugų sutartys – civiliniuose santykiuose dažnai naudojama teisinė priemonė, kuria siekiama nustatyti priešpriešinius įsipareigojimus tarp paslaugų teikėjo ir kliento. Nepaisant kasdienio paslaugų vartojimo, šis institutas yra laikomas vienu iš prievolių ir civilinių teisių bei pareigų atsiradimo pagrindų, todėl jurisdikcijoje yra išskiriamas į atskirą reglamentavimo skirsnį. Tačiau, kaip yra matoma iš magistrinio darbo analizės, paslaugų sutartis pasižymi sudėtinga konstrukcija, nėra apibrėžtos universalios paslaugų sutarties sąvokos. Todėl neretai kyla ginčų tarp paslaugų sutarties šalių, aiškinantis tarpusavio teises ir pareigas. Magistrinio darbo tema analizuota remiantis šiais paslaugų sutartinius santykius reglamentuojančiais šaltiniais: CK ir DCFR. Analizė atliekama lyginamuoju metodu, lyginant CK paslaugų sutarties nuostatas su DCFR šį institutą reglamentuojančiomis nuostatomis. Darbe buvo lyginamos nuostatos, reguliuojančios paslaugų sutarties sąvoką, šalių santykius, paslaugų kainos nuostatas bei paslaugų sutarties neįvykdymo teisines pasekmes. Iš atliktos analizės matyti, kad dauguma CK ir DCFR paslaugų sutartis reglamentuojančių normų iš esmės sutampa, tam didelę reikšmę turėjo pastangos suvienodinti Europos Sąjungos valstybių narių teisinį reguliavimą. Tačiau yra ir nemažai esminių skirtumų, kurie atsiranda, pavyzdžiui, dėl paslaugų sutarties instituto objekto ar kito požymio. / Contracts of Services: the Civil Code Compared to the Draft Common Frame of Reference Service contracts - legal instrument often used in civil relations which seeks to establish set-off obligations between the provider and client. Despite the daily consumption of services, this institute is considered one of the obligations and civil rights and obligations incurred, and thus has jurisdiction over isolated in a separate section of the regulation. However, as is seen from the master work of analysis, the Service Agreement has a complex structure and there is no universal service contract term definition. Therefore, often a dispute arises between contractors, interpreting the mutual rights and obligations. Master's thesis analyzed on the basis of these services contractual relationship governing sources: the Civil Code and the Draft Common Frame of Reference. Analysis carried out a comparative approach, comparing the contract service provisions of the Civil Code with the provisions of Draft Common Frame of Reference. The paper compares the provisions governing the concept of a service contract, the parties' relationship, service and price of the service contract to fulfill the legal consequences. One element of best value contracting is to consider factors along with price in the source selection process to achieve a perceived best value to the Government. Past performance measurement and its use in best value procurements has been developed since the early 1990s. This thesis explores the past performance guidance within DoD in its use as a source selection factor. Automated tools for tracking past performance will be examined as well as their effectiveness and problems associated with data collection and use. Several steps must occur prior to past performance playing the role that it was envisioned with its inclusion as a factor along with price in the source selection process. So that past performance data can be used more effectively, this thesis recommends that contracting personnel and contractors establish a process that standardizes the method of measurement, automates its collection, and allows for viewing across the spectrum of past performance data. Approved for public release; distribution is unlimited / The Department of Defense continues to aggressively pursue A-76 competitive sourcing targets set by the Office of Management and Budget. As more A-76 acquisitions are processed, it is imperative that these studies are conducted fairly and efficiently. Legal challenges to A-76 actions disrupt the process and have a negative impact on the organizations and people undergoing study. Historically, industry has successfully protested a high percentage of A-76 procurements. This thesis examines General Accounting Office A-76 bid protest decisions issued between 5 February 1996 and 23 December 2002. The cases and protest issues are analyzed to determine the reasons that A-76 protests were lodged, and the reasons that A-76 protests were lost by the Government. The thesis identifies common themes, trends, and key issues, and draws conclusions based on that information. Recommendations for A-76 process improvements are developed and provided. It is the researcher's hope that this thesis will be of benefit to A-76 personnel, particularly to Government acquisition personnel responsible for conducting A-76 competitions in the future. / Civilian, Department of the Navy

The nature of rights of relief arising from a cautionary relationship

In Scots law, a creditor may enlist the aid of a third party known as a 'cautioner', who agrees to pay the creditor if the principal debtor defaults. Should the creditor see fit to sue the cautioner, the latter may seek compensation from the principal debtor for the whole amount paid or, if there are other cautioners, a pro rata contribution from the ones who did not pay. While these so-called rights of 'relief' are well established in Scottish case law, there is increasing controversy as to their nature. The present thesis engages with this problem headon, identifying the rationales for a cautioner's various rights of relief and examining how those rationales shape the content of the cautioner's claim in each case. By considering relief within the restricted confines of a cautionary relationship, the thesis aims to demystify a subject that is often complex and diffuse. It also seeks to establish the subject as a free-standing entity, independent of the historical and substantive inter-mixtures through which it has often been conceived in Scots law. After placing the cautioner's rights of relief into their private-law context (Chapters One to Five), the thesis examines each of these rights in detail. Chapter Six considers the basis of a cautioner's right to 'pro rata relief', and Chapter Seven discusses the content of that right, with particular reference to cases where there are three or more cautioners. Chapter Eight builds on the analysis in Chapter Six by determining on what basis a cautioner may claim 'total relief' from the principal debtor. Finally, Chapter Nine examines a cautioner's right to seek relief before paying anything to the creditor.
