This sector lacks attention due to the absence of legal regulation, on the other hand it is one of the greatest sources of wealth for the country's economy, therefore it should have a better regulation. The work pointed out that, from the perspective of the literature consulted, as well as from the perspective of the interviewees, the project of the new commercial code must have a modernization designation of all the agribusiness sectors, needing to discuss the matter at the national level to avoid damages to the small producers, guaranteeing greater compliance in contracts that until then have been processed customarily, Increasing legal certainty for all parties involved, encouraging greater investment and decreasing legal demands and their costs. / O objetivo deste trabalho é analisar a relação contratual na avicultura sob a regulamentação do novo projeto do código comercial, que criará regras específicas para relação entre pessoas jurídicas e físicas do agronegócio, por meio da melhor regulamentação dos contratos. Esse setor carece de atenção pela ausência de regramento legal, por outro lado é uma das maiores fontes de riquezas para economia do país, portanto deveria ter uma melhor regulamentação, O trabalho apontou que, sob a ótica da literatura consultada, bem como sob a perspectiva dos entrevistados, o projeto do novo código comercial deve ter um designo de modernização de todos os setores do agronegócio, necessitando discutir a matéria em nível nacional para evitar prejuízos aos pequenos produtores, garantindo maior cumprimento nos contratos que até então são processados de forma costumeiras, aumentando a segurança jurídica para todas as partes envolvidas, incentivando maior investimento e diminuição de demandas judiciais e seus custos.
