Die Arbeit gliedert sich in 6 Kapitel. Das 1. behandelt die Anwendbarkeit des deutschen Strafrechts im Rahmen der Internetkriminalität, insbesondere bei § 184 StGB. Hier wird besonders eingegangen auf das Territorialitäts- und das Weltrechtsprinzip und die Frage des Erfolges von abstrakten Gefährdungsdelikten aufgegriffen. Im 2. Kapitel wird § 184 näher betrachtet, d.h. der Schutzzweck wird erörtert und eine Normananlyse durchgeführt. Kapitel 3 behandelt die strafrechtliche Verantwortlichkeit der am Kommunikationsprozess beteiligten Personen (User, Provider). Dabei wird auch ein Blick auf das TDG und EGG geworfen. Anschließend geht es in Kap. 4 und die Stafverfolgung im Internet, d.h. um prozessrechtliche Probleme. Schließlich beschäftigt sich Kap. 5 mit der Cybercrimeconvention und Kap. 6 liefert eine Zusammenfassung. / Childpornografy

Kybernetická krimnalita / Cyber crime

Development of information technology is one of the most dynamic parts of today's global society. Along with the coming of new technologies it generates new types of crime, eventually existing types of criminal activities in this area are moving from the real world to cyberspace. This rapid development of cyber crime enforces corresponding changes in the legislation related to cyberspace. In the Czech Republic the most fundamental changes in cyber crime law have been made along with the new Criminal Code. The new code has modified some areas, that were not mentioned by previous criminal code, refined or amended previous terminology related to cyberspace and added institutes required by international commitments, especially by the Convention on Cybercrime. The purpose of this diploma thesis on "Cyber crime" is to outline the issues of cyber-crime, point out some troubling topics, which are currently present in cyberspace, and outline possible future development of criminal law in cyberspace. In the beginning of the thesis there is a short summary of cyberspace and cyber crime history, that is followed by definitions of selected basic concepts of cyberspace and cyber crime. This diploma thesis deals with European Union and current security threats, concretely with Cyberterrorism. Cyberspace and internet became essential parts of our living over the last decades due to rapid development of information and communication technology. The increased dependency on cyberspace is visible in all governmental operations, public-private sector, financial and business operations, as well as communications between individuals and groups. As a result our society is facing new threats. On one hand cyberspace is a place for economic growth and innovation, on the other hand criminals, spies and terrorist use cyberspace as a place for their activities. Our society should be aware of these negative impacts as well. Cyberterrorism by its nature is considered to be a very dynamic phenomenon. Regarding this fact this thesis provides a dynamic way how to define Cyberterrorism and reveals main perspectives of Cyberterrorism. Tracking the European Unions Convention on Cybercrime and main means to fight Cyberterrorism, this thesis analysis whether European Union disposes of appropriate means to engulf the dynamic nature of this phenomenon.

Právní aspekty boje proti počítačové trestné činnosti / Legal Aspects of Fighting Cybercrime

The thesis deals with the topic of computer crime. Foremost, it demonstrates on an example of the operation of a medical image information processing system some selected aspects of this issue. It shows that it is always necessary to monitor the current state of the technical knowledge at the time, but also the need of addressing the issue within the corresponding legal limits. The thesis presents criminal law reality as a complex system. The links between different parts of the system are examined, and possible shortcomings are considered. The legal instruments and legal limits of the procedures that can be used against cybercrime are evaluated. The thesis focuses especially on the issue of obtaining evidence under the Czech Criminal Procedure Code. It presents a proposal on how to understand individual procedural legal institutes and for what purposes and how to use them. Consequently it suggests legal procedures for specific selected practical situations.
