No. of bitstreams: 2 license_rdf: 811 bytes, checksum: e39d27027a6cc9cb039ad269a5db8e34 (MD5) TESE Miguel Ângelo Silva de Melo.pdf: 2167117 bytes, checksum: 98f99542222dbfa084cabe3851ff7788 (MD5) Previous issue date: 2017-03-15 / Este estudo objetivou, por um lado, analisar a construção social dos crimes de ódio motivados pela homofobia, a partir das argumentações jurídicas e policiais de um caso concreto transitado em julgado; por outro lado, visa analisar como o Judiciário processa os casos de crimes homofóbicos no Estado do Ceará, ou seja, como os estereótipos (estigmas) de gênero e de sexualidade impactam no julgamento de casos de homicídios motivados pela orientação sexual e identidade de gênero da vítima. A metodologia utilizada foi estruturada a partir da análise documental, tendo como procedimento para a construção dos dados, a seleção de trechos dos discursos jurídicos do processo criminal que vitimizou José Roberto Xermundo Carvali, na cidade de Bom Jardim / Ceará. O procedimento do estudo de caso, enquanto estudo exploratório e descritivo, permitiu que se verificasse que tanto a trajetória dos crimes de ódio, quanto peculiaridades da violência homofóbica. A análise das estruturas normativas e empíricas, presentes no processo em estudo, bem como, nos inquéritos policiais criminais, contribuiu para a formulação dos específicos objetos da pesquisa: 1) identificar os posicionamentos e dinâmicas que tentam excluir ou incluir a (i)licitude da acusação de práticas homofóbicas; II – apontar automatismos e condutas heterossexistas no complexo sistema de justiça criminal que dificultam e impedem a criminalização dos crimes letais homofóbicos; III – identificar os motivos da prática jurídica do Ministério Público que desqualificou, no caso em estudo, o crime de homicídio (atentado contra a vida) em crime de latrocínio (atentado contra o patrimônio). Ao longo do estudo investigativo fiz uso de um referencial interacionista simbólico e desconstrutivista, os quais foram capazes de indicar as tensões e as contradições entre as práticas do Ministério Público e da Polícia Judiciária na produção de verdades jurídicas. A articulação teórica entre duas abordagens, à primeira vista antagônicas e/ ou problemáticas, tornou possível que os elementos homofóbicos, dentro de uma crítica à perspectiva normativa, institucionalmente presentes no funcionamento do sistema de justiça criminal, fossem demonstrados. / The purpose of this study was to analyze the social construction of hate crimes motivated by homophobia, based on the legal and police arguments of a concrete case that has become final; On the other hand, it aims to analyze how the Judiciary processes cases of homophobic crimes in the State of Ceará, that is, how stereotypes (stigmas) of gender and sexuality impact on the prosecution of homicide cases motivated by sexual orientation and gender identity. victim. The methodology used was structured from the documentary analysis, having as a procedure for the construction of the data, the selection of excerpts from the legal discourses of the criminal process that victimized José Roberto Xermundo Carvali, in the city of Bom Jardim / Ceará. The case study procedure, as an exploratory and descriptive study, allowed us to verify that both the trajectory of hate crimes and the peculiarities of homophobic violence. The analysis of the normative and empirical structures present in the process under study, as well as in criminal police investigations, contributed to the formulation of the specific objects of the research: 1) identify the positions and dynamics that try to exclude or include (i) Accusation of homophobic practices; II - to point out heterosexist automatisms and behaviors in the complex criminal justice system that hinder and prevent the criminalization of homophobic lethal crimes; III - identify the reasons for the legal practice of the Public Prosecutor's Office, which in the present case disqualified the crime of murder (attempted murder) in the crime of robbery (attack on property). Throughout the investigative study I made use of a symbolic and deconstructive interactionist reference, which were able to indicate the tensions and contradictions between the practices of the Public Ministry and the Judiciary Police in the production of legal truths. The theoretical articulation between two antagonistic and / or problematic approaches at first glance made it possible for the homophobic elements, within a critique of the normative perspective, to be institutionally present in the functioning of the criminal justice system to be demonstrated.
